MARINE (DELEGATION OF MINISTERIAL FUNCTIONS) (NO. 2) ORDER 2005


The Government, on the request of the Minister for Communications, Marine and Natural Resources and in exercise of the powers conferred on them by section 2(1) of the Ministers and Secretaries (Amendment) (No. 2) Act 1977 (No. 28 of 1977), hereby order as follows:

1.         This Order may be cited as the Marine (Delegation of Ministerial Functions) (No. 2 Order 2005.

2.         The powers and duties of the Minister for Communications, Marine and Natural Resources conferred on him -

(a)        by or under the Sea Pollution (Hazardous Substances (Compensation) Act 2005 (No. 9 of 2005),

(b)        by or under the Maritime Safety Act 2005 (No. 11 of 2005), and

(c)        under the European Communities (Sea Fisheries)(Conservation and Rational Exploitation of Scallops) Regulations 2005 ( S.I. No. 297 of 2005 ),

are delegated to Pat the Cope Gallagher, Minister of State at the Department of Communications, Marine and Natural Resources.

EXPLANATORY NOTE

(This Note is not part of the Instrument and does not purport to be a legal interpretation.)

The Government made this Order to delegate to Pat the Cope Gallagher T.D., Minister of State at the Department of Communications, Marine and Natural Resources, functions of the Minister for Communications, Marine and Natural Resources under the recent Acts and Regulations referred to in the Order.

This Order complements the 3 Government Orders previously made in favour of Minister Gallagher in his current position:

S.I. No. 703 of 2004 -

covering all Acts relating to marine matters which are administered by the Department of Communications, Marine and Natural Resources

S.I. No. 769 of 2004 -

covering Acts administered by other Departments, as well as European Communities Regulations, relating to marine matters.

S.I. No. 82 of 2005 -

covering European Communities (Live Bivalve Molluscs Regulations 1996 to 2000.
