S.I. No. 292/2005 - Wireless Telegraphy Act, 1926 (Section 3) (Exemption of Receive Only Apparatus For Wireless Telegraphy) (Amendment) Order 2005


The Commission for Communications Regulation, in exercise of the powers conferred on it by subsection 6 (inserted by section 11 (c) of the Wireless Telegraphy Act, 1972 (No. 5 of 1972)) of section 3 of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), transferred to the Commission for Communications Regulation by section 9 (1) of the Communications Regulation Act 2002 (No. 20 of 2002) hereby makes the following Order:

1.         This Order may be cited as the Wireless Telegraphy Act, 1926 (section 3 (Exemption of Receive Only Apparatus for Wireless Telegraphy)(Amendment Order 2005.

2.         In this Order-

“Principal Order” means the Wireless Telegraphy Act, 1926 (section 3) (Exemption of Receive Only Apparatus for Wireless Telegraphy) Order 2005 ( S.I. No.197 of 2005 ); and

“television set” means any apparatus for wireless telegraphy capable of receiving and exhibiting television programmes broadcast for general reception (whether or not its use for that purpose is dependent on the use of anything else in conjunction therewith) and any assembly comprising such apparatus and other apparatus.

3.         Article 3 of the Principal Order is amended by substituting for “which is not licensed under the Television Licences Regulations 2005 ( S.I. No. 165 of 2005 )” the following:

“which is not a television set”
