IRISH AVIATION AUTHORITY (OPERATIONS) (AMENDMENT) ORDER, 2005

S.I. No. 217 of 2005

The Irish Aviation Authority in pursuance of sections 5, 14, 58, 59, 60 and 67 of the Irish Aviation Authority Act, 1993 (No. 29 of 1993) as amended, hereby orders as follows:

Short Title and Commencement

1.     (1)    This Order may be cited as the Irish Aviation Authority (Operations (Amendment) Order, 2005;

(2)    In this Order “the Principal Order” means the Irish Aviation Authority (Operations) Order, 2002 ( S.I. No 437 of 2002 );

(3)    The Principal Order, the Irish Aviation Authority (Operations) (Amendment Order, 2002 ( S.I. No. 592 of 2002 ), the Irish Aviation Authority (Operations (Amendment) Order, 2003 ( S.I. No. 388 of 2003 ) and this Order may be cited together as the Irish Aviation Authority (Operations) Orders 2002 to 2005;

(4)    This Order shall come into operation with immediate effect on the date of its publication in the Iris Oifigiúil.

Amendment to the Principal Order

2.     The principal Order is amended as follows:

(1)    In Paragraph (2) of Article 20 of the Order:

Delete the second explanatory subparagraph relating to aerodrome emergency facilities such as those for fire-fighting, search and rescue.

(2)    In paragraph 5 of the First Schedule to the Order, delete subparagraph (1)(j and replace it with:

“(j)   means of protecting the flight crew compartment from unauthorised access and the flight crew from unlawful interference; where an aeroplane is equipped as required by Annex 6 to the Convention, or by JAA requirements, with a flight crew compartment door that is designed to resist small arms fire, grenade shrapnel and forcible intrusion by unauthorised persons, such a door and its installation shall be of an approved type and shall be capable of being locked or unlocked from either pilot’s station in the flight crew compartment only and means shall be provided by which the cabin crew can discreetly communicate with the flight crew where events in the cabin may render that necessary or desirable; where means is provided in an aeroplane as required by Annex 6 to the Convention, or by JAA requirements, to monitor from the flight deck the door area outside the flight crew compartment, such a monitoring system shall be of an approved type.”

EXPLANATORY NOTE

This Amendment Order amends the Principal Order to accommodate minor amendments in respect of Article 20, to reflect Annex 6 to the Convention and to paragraph 5 of the First Schedule to the Order in respect of the flight crew compartment, to add a reference to JAA requirements.
