S.I. No. 889/2004 - Oireachtas (Ministerial and Parliamentary Offices) (Secretarial Facilities) (No. 6) Regulations 2004


The Houses of the Oireachtas Commission, in exercise of the powers conferred on it by section 10 (4) of the Ministerial and Parliamentary Offices Act 1938 (inserted by section 1 of the Oireachtas (Ministerial and Parliamentary Offices) (Amendment) Act 2001 and transferred by section 4 (3)(a) of the Houses of the Oireachtas Commission Act 2003 ) and section 2 (1)(c) of the Oireachtas (Allowances to Members) Act 1962 (inserted by section 3 of the Oireachtas (Miscellaneous Provisions) and Ministerial and Parliamentary Offices (Amendment) Act 1996 and transferred by section 4 (3)(b) of the Houses of the Oireachtas Commission Act 2003 ), hereby makes the following regulations:

1.  (1)  These Regulations may be cited as the Oireachtas (Ministerial and Parliamentary Offices) (Secretarial Facilities) (No. 6) Regulations 2004.

(2)  These Regulations shall come into operation on 1 January 2005.

2.  In these Regulations:

—  “the 2004 Regulations” means the Oireachtas (Ministerial and Parliamentary Offices) (Secretarial Facilities) (No. 5) Regulations 2004.

3.  Regulation 2 of the 2004 Regulations shall be amended by the addition of the following definitions:

—  “Independent Member” means a Member of either House of the Oireachtas who is not a member of a Qualifying Party;

—  “Technical Group” means the Group established on 9th October 2002 pursuant to Standing Order 114(1)(b) of the Standing Orders of Dáil Éireann relative to Public Business.

4.  Regulations 3 and 4 of the 2004 Regulations shall be amended by the addition of the following words to both Regulations:

“provided that Independent Members shall be entitled to avail of the services of a Graphic Designer to the extent indicated in row 4, column 3 of the table in Schedule 2”.

5.  The table in Schedule 2 of the 2004 Regulations shall be amended as follows:

—  in row 1, column 1, by the addition in the line after ‘Secretarial Assistants’ of ‘Graphic Designer at Administrative Assistant level’ and in row 1, column 3, by the insertion of the figure ‘1’ in the corresponding line;

—  in row 2, column 2, by the addition in the line after ‘Secretarial Assistants’ of ‘Graphic Designer at Administrative Assistant level’ and in row 2, column 3, by the insertion of the figure ‘1’ in the corresponding line;

—  in row 3, column 2, by the addition in the line after ‘Secretarial Assistants’ of ‘Graphic Designer at Administrative Assistant level’ and in row 3, column 3, by the insertion of the figure ‘1’ in the corresponding line;

—  in row 4, column 2, by the addition in the line after ‘Secretarial Assistants’ of ‘Graphic Designer at Administrative Assistant level’ and in row 4, column 3, by the insertion of the text ‘1, to be shared with Independent Members who are not members of the Technical Group’ in the corresponding line;

—  in row 5, column 2, by the addition in the line after ‘Secretarial Assistants’ of ‘Graphic Designer at Administrative Assistant level’ and in row 5, column 3, by the insertion of the text ‘1, to be shared with the other members of the Technical Group’ in the corresponding line;

—  in row 6, column 2, by the addition in the line after ‘Secretarial Assistants’ of ‘Graphic Designer at Administrative Assistant level’ and in row 6, column 3, by the insertion of the text ‘1, to be shared with the other members of the Technical Group’ in the corresponding line;

—  in row 7, column 2, by the substitution for ‘—’ of ‘Graphic Designer at Administrative Assistant level’ and in row 7, column 3, by the substitution for ‘—’ of the text ‘1, to be shared with the other members of the Technical Group’.

6.  These Regulations shall cease to have effect on 31 March 2005.

The purpose of these Regulations is to make temporary provision for the employment of a graphic designer by each qualifying party and by the Technical Group constituted under the Standing Orders of Dáil Éireann.
