S.I. No. 86/2004 - Nature Reserve (Fenor Bog) Recognition Order 2004


I, MARTIN CULLEN, Minister for the Environment, Heritage and Local Government, after consultation with the Minister for Agriculture and Food, the Minister for Communications, Marine and Natural Resources, the Minister for Transport, the Commissioners of Public Works in Ireland and Waterford County Council, being satisfied by the person who is the occupier of the land specified in Article 2 of the following Order, that—

(a) the land so specified includes an ecosystem described in Section 15(2) (as amended by Section 26 of the Wildlife (Amendment) Act 2000 (No. 38 of 2000) of the Wildlife Act 1976 (No. 39 of 1976),

(b) the interest of the said person in or over the said land is such as to enable the person to establish and manage a nature reserve on the said land, and

(c) the person can, in accordance with any conditions which the Minister for the Environment, Heritage and Local Government sees fit to impose, use or manage the said land so as to establish and maintain, or maintain as may be appropriate, a nature reserve on the said land,

and in exercise of the powers conferred on me by Section 16 (as amended by Section 27 of the Wildlife (Amendment) Act 2000 ) of the Wildlife Act 1976 and the Heritage (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 356 of 2002 ) (and as adapted by the Environment and Local Government (Alteration of Name of Department and Title of Minister) Order 2003 ( S.I. No. 233 of 2003 ), hereby order as follows:

1. This Order may be cited as the Nature Reserve (Fenor Bog) Recognition Order 2004.

2. The area of land known as Fenor Bog in the townland of Fenor (otherwise known as Fennor) in the county of Waterford (being the land delineated on the map annexed to this Order within the inner margin of the black line and hatched thereon in black) is recognised as a nature reserve.

The Order recognises the land at Fenor Bog, County Waterford, as a nature reserve so that it can be managed in such a way as to ensure the conservation of the swamp, fen and bog ecosystem which it constitutes.
