S.I. No. 82/2004 - Diplomatic and Consular Fees (Amendment) Regulations 2004


I, BRIAN COWEN, Minister for Foreign Affairs, in exercise of the powers conferred on me by section 3 of the Diplomatic and Consular Officers (Provision of Services) Act 1993 (No. 33 of 1993), and with the consent of the Minister for Finance, hereby make the following Regulations:

1.  (1)  These Regulations may be cited as the Diplomatic and Consular Fees (Amendment) Regulations 2004.

(2)  These Regulations shall come into operation on 1 March, 2004.

2.  The Diplomatic and Consular Fees Regulations 2001 ( S.I. No. 117 of 2001 ) are amended—

(a)  in Regulation 4, by the insertion of the following definitions:

“ ‘apostille’ means the certificate described in Article 4 of the Hague Convention Abolishing the Requirement of Legalisation for Foreign Public Documents, done at The Hague on 5 October 1961 and annexed to that Convention;

‘European Union Emergency Travel Document’ means the document established in accordance with the Decision1 of the Representatives of the Governments of the Member States of the European Union, meeting within the Council of 25 June 1996, on the establishment of an emergency travel document (96/409/CFSP);”,

(b)  by the substitution of the Schedule set out in Part 1 of the Schedule to these Regulations for the First Schedule, and

(c)  by the substitution of the Schedule set out in Part 2 of the Schedule to these Regulations for the Second Schedule.

€25 for each hour or fraction thereof, with a maximum per day of €200

For the provision of any service (other than the issue of a passport in the circumstances provided for in Regulation 9(e) of these Regulations), for which a fee is charged under these Regulations, whether at a diplomatic or consular office or at a diplomatic or consular officer’s residence, in addition to such fee, for each half-hour, or fraction thereof, out-side its normal hours of opening

(This fee is chargeable for any attendance on weekends and public holidays.)

 

Part 2

“SECOND SCHEDULE

Part I

Passports

(This fee is charged for any attendance on weekends and public holidays.)

The fee specified at reference number 12 in the First Schedule to these Regulations shall not be charged for the issue of a passport in these circumstances.

For the issue of an emergency passport of limited validity to a person under 18 years of age by the relevant Passport Office, diplomatic mission or consular post outside its normal hours of opening. In addition, the applicable fee specified at reference number 3 or 4 in this Part for the subsequent issue of a three or five year passport as appropriate shall be payable.

(This fee is charged for any attendance on weekends and public holidays.)

The fee specified at reference number 12 in the First Schedule to these Regulations shall not be charged for the issue of a passport in these circumstances.

For the issue of a passport to a person over 18 years of age by the relevant Passport Office, diplomatic mission or consular post during normal hours of opening on the same day that the application was submitted or on the day after the application was submitted. In addition, the applicable fee specified at reference number 1, 2, or 5 in this Part shall be payable.

For the issue of a passport to a person under 18 of age by the relevant Passport Office, diplomatic mission or consular post during normal hours of opening on the same day that the application was submitted or on the day after the application was submitted. In addition, the applicable fee specified at reference number 3 or 4 in this Part shall be payable.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The purpose of these Regulations are to amend the Diplomatic and Consular Fees Regulations, 2001, to provide for rewording of the descriptions of services in the First and Second Schedules to make them more relevant to the consular services that are now provided, to provide for changes in the fee structure and increases in fees for passports (Part I of the Second Schedule), and to provide for increases in the fees for miscellaneous consular services (First Schedule), for visas, work authorisations and working holiday authorisations (Part II of the Second Schedule) and for Oaths, Affidavits and Notarial Acts (Part III of the Second Schedule).
