EUROPEAN COMMUNITIES (SEED OF FODDER PLANTS) (AMENDMENT) (NO. 2) REGULATIONS, 2004.

I, MARY COUGHLAN, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive 2004/55/EC of 20 April 2004¹ , hereby make the following regulations—

1. These Regulations may be cited as the European Communities (Seed of Fodder Plants) (Amendment) (No. 2) Regulations 2004 and comes into operation on 30 September 2004.

2. The European Communities (Seed of Fodder Plants) Regulations 2002 ( S.I. No. 198 of 2002 ) are amended—

(a)  in Regulation 2(1) by substituting in the definition of fodder plants for—

(i) “Festuca pratensis Huds. x Lolium multiflorum Lam.” the following:

“Festuca spp. x Lolium spp.”,

and

(ii) “Hybrid resulting from the crossing of tall fescue with Italian ryegrass (including Wester-world ryegrass) (x festulolium)” the following:

“Hybrids resulting from the crossing of a species of the genus Festuca with a species of the genus Lolium (x Festulolium)”,

(b)  in regulation 2(2) by substituting for “and Council Directive 2001/64/EC of 31 August 2001³⁴ .” the following:

“, Council Directive 2001/64/EC of 31 August 2001³⁴ and Commission Directive 2004/55/EC of 20 April 2004³⁵ .”,

(c)  in Schedule 1, Annex II, 1(2), column 2 of the table, for the entry relating to Vicia faba, by substituting “80” for “85”,

(d)  in Schedule 1, Annex IV, A I(a)4 by inserting after “in roman characters.” the following:

“In the case of x Festulolium the names of the species within the genus Festuca and Lolium shall be indicated.”,

(e)  in Schedule 1, Annex IV, A I(b)4 by inserting after “and officially recorded.” the following:

“In the case of x Festulolium the names of the species within the genus Festuca and Lolium shall be indicated.”,

(f)  in Schedule 1, Annex V, (A) 2 by inserting after “in roman characters,” the following:

“in the case of x Festulolium the names of the species within the genus Festuca and Lolium shall be indicated.”,

(g)  in Schedule 1, Annex V, (C) 2 by inserting after “in roman characters,” the following:

“in the case of x Festulolium the names of the species within the genus Festuca and Lolium shall be indicated.”.

3.  The European Communities (Seed of Fodder Plants) (Amendment) Regulations 2004 ( S.I. No. 527 of 2004 ) are revoked.

These Regulations give effect to Commission Directive 2004/55/EC amending Council Directive 66/401/EEC on the marketing of fodder plant seed.
