S.I. No. 205/2004 - Marketing of Non-Eec Fertilisers Regulations (Amendment) Regulations 2004


I. Joe Walsh, Minister for Agriculture and Food, in exercise of the powers conferred on me by sections 2 , 4 and 5 of the Fertilisers, Feedingstuffs and Mineral Mixtures Act 1955 (No. 8 of 1955), after consultation with the Minister for Enterprise, Trade and Employment, hereby make the following regulations:-

1.         These Regulations may be cited as the Marketing of Non-EEC Fertilisers Regulations (Amendment) Regulations 2004.

2.         The Marketing of Non-EEC Fertilisers Regulations 1978 ( S.I. No. 248 of 1978 ) are amended

(a)        by inserting, in Regulation 2(1) after the definition of “ground limestone”-

“’inhibitor’ means a substance that may be incorporated in a fertiliser which effects the efficacy of the fertiliser;”

(b)        by inserting after Regulation 4-

“4A    A person shall not sell a fertilizer named in column (1) of Part II to the First Schedule to these Regulations (inserted by the Marketing of Non-EEC Fertilisers (Amendment) Regulations 2004 (S.I. No. of 2004)) that contains an inhibitor, other than an inhibitor named opposite the mention of the fertiliser in column (2) of the said Part II in accordance with the conditions set out in columns (3), (4) and (5) of that Part.”, and

(c)        by inserting, in the Schedule, the matter in the Schedule to these Regulations.

Nitrification Inhibitor:- 3,4- Dimethylpyrazole phosphate (DMPP)

Minimum of 0.8 % DMPP, expressed as a % of the total ammoniacal, ureic and cyanamide nitrogen

Content of DMPP, expressed as a % of the total ammoniacal, ureic and cyanamide nitrogen

Fertiliser type designation, followed by: “with nitrification inhibitor 3,4- Dimethylpyrazole phosphate”

Solid urea

Urease Inhibitor:- N-butyl-thiophosphoric-triamide (NBPT)

Minimum of 0.05% NBPT in the solid urea

Percentage of NBPT in the solid urea.
