S.I. No. 200/2004 - European Communities (Assembly Centres) (Amendment) Regulations, 2004


I, JOE WALSH, Minister for Agriculture and Food, in exercise of the powers conferred on me by sections 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purpose of giving effect to Council Directive 97/12/EC1 of 17 March 1997 as amended by Council Directive 98/99/EC2 of 14 December 1998, in so far as it applies to assembly centres, hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Assembly Centres) (Amendment) Regulations, 2004.

2. Article 4 of the European Communities (Assembly Centres) Regulations, 2000 is amended by substituting the following for paragraph 2 -

‘Where the Minister proposes to refuse to grant an approval or to revoke an approval he or she shall-

a)   notify in writing the owner or person in charge of the proposal and of the reasons therefor,

b)   notify that person in writing that he or she or a person acting on his or her behalf, may make representations to the Minister in relation to the proposal within 14 days of the receipt by him or her of the notification, and

c)   consider any such representations duly made before deciding whether or not to proceed with the proposal.’
