S.I. No. 90/2003 - Planning and Development Regulations 2003


The Minister for the Environment and Local Government, in exercise of the powers conferred on him by sections 96B (as inserted by section 4 of the Planning and Development (Amendment) Act, 2002 (No. 32 of 2002)), 97 , 100 and 262 of the Planning and Development Act 2000 (No. 30 of 2000) hereby makes the following Regulations:

Citation and commencement.

1.      (1)      These Regulations may be cited as the Planning and Development Regulations, 2003.

 (2)      These Regulations and the Planning and Development Regulations 2001 to 2002 shall be construed as one and may be collectively cited as the Planning and Development Regulations 2001 to 2003.

Interpretation.

2.                 In these Regulations, except where the context otherwise requires, “the Regulations” means the Planning and Development Regulations 2001.

Amendment of Article 49(b) of Regulations.

3.                 Article 49(b) of the Regulations is hereby amended by the substitution of “0.1 hectares” for “0.2 hectares”.

Amendment of Article 50 of Regulations.

4.                 Article 50 of the Regulations is hereby amended by the substitution of the following for that article:

“50. The minimum size of accommodation required by eligible persons for the purposes of section 100(1)(a) of the Act shall be —

(a)  for one person, a house with one bedroom and gross floor area of 38 square metres,

(b)  for 2 persons, a house with one bedroom and a gross floor area of 42 square metres,

(c)  for 3 persons, a house with 2 bedrooms and a gross floor area of 52 square metres,

(d)  for 4 persons, a house with 2 bedrooms and a gross floor area of 62 square metres,

(e)  for 5 persons, a house with 3 bedrooms and a gross floor area of 74 square metres,

(f)  for 6 persons, a house with 3 bedrooms and a gross floor area of 78 square metres, or

(g)  for 7 or more persons, a house with 4 bedrooms and a gross floor area of 92 square metres.”.

Receipt of Payment to Local Authority required under Section 96(B) of Planning and Development Act, 2000 (as inserted by Section 4 of Planning and Development (Amendment Act, 2002).

5.                 A receipt issued as evidence of the making of a payment under section 96B of the Planning and Development Act, 2000 (as inserted by section 4 of the Planning and Development (Amendment) Act, 2002 ) shall be in the form set out in the Schedule to these Regulations or a form substantially to the like effect.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The purpose of these Regulations is to make certain changes to Part 5 of the Planning and Development Regulations 2001 and to provide the format of a receipt for the payment under section 96B of the Planning and Development Act, 2000 (as inserted by section 4 of the Planning and Development (Amendment) Act, 2002 ).

* The map site plan should indicate clearly the house or houses in respect of which the payment has been made.
