S.I. No. 486/2003 - Road Vehicles (Registration and Licensing) (Amendment) Regulations, 2003


The Minister for the Environment, Heritage and Local Government in exercise of the powers conferred on him by sections 5 and 12 of the Roads Act, 1920, section 1 of the Finance (Excise Duties)(Vehicles) Act, 1952 (No. 24 of 1952), section 123 of the Road Traffic Act, 1961 (No. 24 of 1961), section 65 of the Finance Act, 1976 (No. 16 of 1976), and section 19 of the Finance (No. 2) Act, 1992 (No. 28 of 1992) hereby makes the following Regulations: -

1.        (1)      These Regulations may be cited as the Road Vehicles (Registration and Licensing)(Amendment) Regulations, 2003.

 (2)      These Regulations and the Road Vehicles (Registration and Licensing Regulations, 1992 to 2001 shall be construed as one and may be cited together as the Road Vehicles (Registration and Licensing Regulations, 1992 to 2003.

 (3)      These Regulations shall come into operation on the 21st day of October 2003.

2.         The Road Vehicles (Registration and Licensing)(Amendment) Regulations 1992 ( S.I. No. 385 of 1992 ) are hereby amended: -

(a)  by the substitution in article 1 of the following for the definition of “authorised officer” and “licensing authority”:

“‘authorised officer” has the meaning assigned to it by the Road Vehicles (Registration and Licensing) Order, 1958 ( S.I. No. 15 of 1958 ),

“licensing authority” has the meaning assigned to it by the Road Vehicles (Registration and Licensing) Order, 1958 (as amended by section 8 of the Motor Vehicle (Duties and Licences) Act 2003 ) but the Minister shall only be a licensing authority for the purposes of articles 2 and 3 of these regulations.”.

(b)  by the insertion of the following after sub-article (1)(b) of article 2:

“(c) For the purpose of this article the owner of a vehicle who desires to obtain a licence for it may make application to the Minister by means of the internet at www.motortax.ie and accordingly the provisions of sub-articles 1(a), 1(b) and (2) of this article shall not apply to applications made under this sub-article.”.
