Rules made pursuant to the provisions of section 25 (A) of the Medical Practitioners Act, 1978 as inserted by the Medical Practitioners (Amendment Act, 2002 .

1.   These rules are made pursuant to the provisions of section 25 (A) of the Medical Practitioners Act, 1978 , as inserted by the Medical Practitioners (Amendment) Act, 2002 for the purpose of specifying prescribed categories, prescribed duties and prescribed procedures referred to in section 29 (5) of the Medical Practitioners Act, 1978 .

2.   An applicant wishing to apply for registration under section 29(5) shall, subject to compliance with the requirements of these Rules and the requirements of the Medical Practitioners Act, 1978 , and the Medical Practitioners (Amendment) Act, 2002 be entitled to be registered.

3. Prescribed Categories and Duties

The following categories and duties have been prescribed for the purpose of section 29 (5) of the Medical Practitioners Act, 1978 as amended:

(a) Demonstration of particular specialist knowledge and skill in hospitals, institutions clinics, general medical practice or a health service setting prescribed by the Medical Council.

An applicant under this rule who is in the State for the purpose of demonstrating his/her particular specialist knowledge and skill may be granted temporary registration for that purpose provided he/she satisfies the following requirements:

(i)  Holds full registration with a registration authority recognised by the Medical Council.

(ii) Holds specialist registration in the specialty area to be demonstrated with a registration authority recognised by the Medical Council or have completed specialist training acceptable to the Medical Council, in the specialty area to be demonstrated.

In addition to the above, the authority/person proposing to retain the services of an applicant for temporary registration under this rule must provide the Medical Council with the following:

(iii) a detailed written statement, outlining the nature of the demonstration of particular specialist knowledge and skill to be performed by the applicant for temporary registration under this rule. This statement must indicate where the demonstration of particular specialist knowledge and skill will take place and the period required for same.

(iv) written confirmation from a medical practitioner fully registered in the General Register of Medical Practitioners that he/she will observe the applicant for temporary registration under this rule, while he/she demonstrates particular specialist knowledge and skill.

(v)  written confirmation that the applicant for temporary registration under this rule has sufficient knowledge of the English language to communicate effectively in respect of his/her particular specialist knowledge and skill with patient(s), medical practitioners and other personnel in connection with and at such demonstrations.

(vi)written confirmation from a fully registered medical practitioner that he/she will be responsible for ensuring continuity of care of patient(s) who have been treated by an applicant granted temporary registration under this rule.

(b) Provision of support services at public events of a sporting, entertainment, political or religious nature.

An applicant under this rule who is in the State for the purpose of providing support services for a public event of a sporting, entertainment, political or religious nature may be granted temporary registration for that purpose provided he/she satisfies the following requirement:

(i)   Holds full registration with a registration authority recognised by the Medical Council.

In addition to the above, the authority/person proposing to retain the services of an applicant for temporary registration under this rule must provide the Medical Council with the following:

(ii)  a written statement outlining why the applicant for registration under this rule has been chosen and what relevant experience he/she possesses for the event for which temporary registration is sought.

(iii) a written statement outlining the nature of the public event at which the applicant for temporary registration under this rule seeks to provide support services. This statement must indicate the venue(s) at which the public event will be held and the duration.

(iv) written confirmation from a medical practitioner fully registered in the General Register of Medical Practitioners that he/she will ensure continuity of care where indicated.

(v) written confirmation that the applicant for temporary registration under this rule has sufficient knowledge of the English language to communicate effectively with the organisers and persons attending the public event.

4.   Application Procedure

4.1 An application for registration shall be made on the printed application form provided by the Medical Council, and should be sent to the Registrar of the Medical Council, with the verifying documents, together with the application fee made payable to the Medical Council at least two months in advance.

4.2 All information required by the application form and these Rules shall be fully accurately and truthfully given and the declaration contained in the application form shall be signed by the applicant.

4.3 The applicant shall submit, with the application, the following documentation and any other documentation/information required by the application form:

(i) An original, currently dated, document from the registration authority with which the applicant is fully registered, confirming that:

(a) he/she holds a degree in medicine;

(b) he/she has completed a satisfactory internship, consisting of not less than one year's relevant experience;

(c) he/she holds specialist registration or has completed specialist training acceptable to the Medical Council as required by rule 3(a)(ii);

(d) he/she is not the subject of disciplinary proceedings and is in good standing.

OR

(e) certified copy of degree/diploma in medicine.

(f) certified copy of Certificate of Experience which certifies completion of internship training. Internship training must consist of a minimum of one year's relevant experience.

(g) original evidence confirming specialist registration or equivalent certification in accordance with rule 3(a)(ii).

(h) Certificate of Good Standing and Fitness to Practise medicine to include confirmation that the applicant is not the subject of disciplinary proceedings from the medical registration authority or equivalent regulatory body with which the applicant holds full registration.

4.4 Certified copy of current passport or certified copy of other documentation acceptable to the Medical Council as evidence of identity. Production of the original document(s) may be required by the Medical Council.

4.5 An applicant who fails to complete the application form and/or who fails to enclose the specified documents may have his/her application declared invalid by the Medical Council. The fee may be refunded, less the processing fee, as determined from time to time by the Medical Council.

5.   Documents

5.1 Any documents required to be submitted under these Rules shall, if not in the English language, be accompanied by an English translation, attested by a translator approved by the Medical Council. All costs associated with the translation of documentation into the English language must be borne by the applicant.

6.   Authorisation

6.1 In considering an application for registration under these Rules, the Medical Council may make any enquiry which it deems necessary concerning the applicant and the information furnished by him/her from any medical, educational or regulatory authority and from any referee, employer or any other person, whether nominated by the applicant or otherwise. The applicant shall supply such further documentation and/or certificates that the Medical Council deems necessary in connection with the application.

6.2 The Medical Council reserves the right to require an applicant to attend to be interviewed for the purpose of supplementing or verifying any of the particulars or information required under these Rules.
