S.I. No. 167/2003 - Ombudsman Superannuation (Amendment) Scheme, 2003.

I, Charlie McCreevy, Minister for Finance, in exercise of the powers conferred on me by section 3 (2) of the Ombudsman Act, 1980 (No. 26 of 1980), hereby make the following scheme:

1.   (1) This Scheme may be cited as the Ombudsman Superannuation (Amendment) Scheme, 2003.

(2) The Principal Scheme and this Scheme may be cited together as the Ombudsman Superannuation Schemes, 1987 and 2003, and shall be construed together as one.

(3) In this Scheme “the Principal Scheme” means the Ombudsman Superannuation Scheme, 1987 ( S.I. No. 70 of 1987 ).

2    The Principal Scheme is hereby amended by the insertion of the following as Article 4(4)

“A member who has completed at least one term of office prior to 1 June, 2003, during which he was appointed Information Commissioner in accordance with section 33 (3) of the Freedom of Information Act 1997 (No. 13 of 1997) and Chairman of the Public Offices Commission in accordance with section 21 (6) of the Ethics in Public Office Act 1995 (No. 22 of 1995) shall receive on his retirement a retirement gratuity of one year's salary in lieu of any benefits which might otherwise be payable under this scheme.”
