S.I. No. 76/2002 - Irish Aviation Authority (Rules of the Air) (Amendment) Order, 2002


The Irish Aviation Authority, in pursuance of sections 58 , 59 and 60 of the Irish Aviation Authority Act 1993 (No. 29 of 1993) as amended by the Air Navigation and Transport (Amendment) Act, 1998 (No. 24 of 1998), hereby orders as follows -

1.     (1)     This Order may be cited as the Irish Aviation Authority (Rules of the Air (Amendment) Order, 2002;

(2)     In this Order “the Principal Order” means the Irish Aviation Authority (Rules of the Air) Order, 2001 ( S.I. No 568 of 2001 );

(3)     The Principal Order and this Order may be cited together as the Irish Aviation Authority (Rules of the Air) Orders 2001 and 2002;

(4)     This Order shall come into operation on the date of its publication in the Iris Oifigiuil or on the first day of April, 2002, whichever date occurs first.

2.     The Principal Order is amended as follows:-

In Rule 34 (General Rules for VFR Flight) -

Replace sub-paragraph (c) of ***Note to paragraph (1) of the Rule with the following sub-paragraph to that Note:-

“(c)    A helicopter may be permitted to operate in less than 1500m flight visibility, where a lower flight visibility is prescribed by the Authority, if manoeuvred at a speed that will give adequate opportunity to observe other traffic or any obstacles in time to avoid collision.”

EXPLANATORY NOTE

This amendment aligns the wording of the subject Note to that of Annex 2 to the Chicago Convention at its current amendment status.
