S.I. No. 633/2002 - Inland Post Amendment (No. 64) Scheme, 2002


An Post, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act 1983 (No. 24 of 1983) as amended by Regulation 4(1) of the European Communities (Postal Services) Regulations 2000 ( S.I. No. 310 of 2000 ), and with the concurrence of the Director of Telecommunications Regulation to the increases in charges herein made hereby makes the following Scheme:

1.     This Scheme may be cited as the Inland Post Amendment (No. 64 Scheme, 2002.

2.   This Scheme shall be operative with effect from the 2nd day of April 2002.

3.     In this Scheme, “the Principal Warrant” means the Inland Post Warrant 1939 ( S.I. No. 202 of 1939 ) as amended;

“Scheme No. 36” means the Inland Post Amendment (No. 36) Scheme 1986 ( S.I. No. 362 of 1986 );

“Scheme No. 47” means the Inland Post Amendment (No. 47) Scheme 1991 ( S.I No. 95 of 1991 );

“Scheme No. 57” means the Inland Post Amendment (No. 57) Scheme 1998 ( S.I No. 129 of 1998 );

“Scheme No. 59” means the Inland Post Amendment (No. 59) Scheme 1998 ( S.I No. 133 of 1998 ).

4.   All rates and charges payable upon letters and postal packets in this Scheme pertain to postal packets within the “reserved area” as defined by the European Communities (Postal Services) Regulations 2000 (S.I. 310 of 2000).

5.   Words defined in the Principal Warrant shall have the same meaning in this Scheme.

6.   By decision of the Director of Telecommunications Regulation dated the 28 th day of March 2002, An Post was authorised, for the period up to and including the 30 th day of June 2002, to apply a surcharge of 3 cent per item to the charges for postal items contained in the following: the First Schedule to Scheme No. 36 (inserted by Regulation 13 of Scheme No. 47 and Regulation 21 of Scheme No. 57); Regulation 10.2 of Scheme No. 36 (as inserted by Regulation 20 of Scheme No. 57); the First Schedule to Scheme No. 59.

7.   By Information Notice dated 1 July 2002 the Director of Telecommunications Regulation indicated that An Post could continue to apply the 3 cent per item surcharge referred to in Regulation 6 hereof until a further decision to concur with increases in charges was made by the Director of Telecommunications Regulation.

EXPLANATORY NOTE

(This Note is not part of the Instrument and does not purport to be a legal interpretation).

This Scheme applies to the Inland Post Service. It authorises An Post to apply a surcharge of 3 cent per item to items posted in An Post's direct mail service within the reserved area as defined in European Communities (Postal Services) Regulations 2000 (S.I.310 of 2000) for the periods set out herein.
