S.I. No. 484/2002 - European Communities (Meat Products and Other Products of Animal Origin) (Amendment) (No. 2) Regulations 2002


I, Joe Walsh, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), to give further effect to Article 3 of Council Directive 77/99/EEC of 21 December 19761 (inserted by Council Directive 92/5/EEC of 10 February 19922 ), hereby make the following regulations-

1.         These Regulations may be cited as the European Communities (Meat Products and Other Products of Animal Origin) (Amendment) (No. 2 Regulations 2002.

2.         The European Communities (Meat Products and Other Products of Animal Origin) Regulations 1995 are amended -

(a)      in Regulation 9(1), by substituting, for subparagraphs (b) and (c) —

“(b)      in the case of establishments without an industrial structure or production capacity, a national health mark.”, and

(b)      in Chapter VI of the Second Schedule (inserted by the European Communities (Meat Products and Other Products of Animal Origin) (Amendment) Regulations 1997 ( S.I. No. 175 of 1997 )), by inserting -

(i)         in paragraph 4(a), “EC” before “health mark”, and

(ii)        after paragraph 4(a) -

“(aa)    Where meat products are to be marketed bearing the national health mark that mark shall consist of a triangular mark containing in legible form and in printed capital letter a county reference prescribed by the Minister and the approval number of the premises.”.

3.         The European Communities (Meat Products and Other Products of Animal Origin (Amendment) Regulations 2002 ( S.I. No. 391 of 2002 are revoked.

Explanatory Note

The purpose of these Regulations is to permit the approval of low capacity meat products premises under the European Communities (Meat Products and Other Products of Animal Origin) Regulations 1995 (S.I. 126 of 1995). These Regulations make provision for the use of a national health mark by operators of such meat products premises.
