S.I. No. 365/2002 - Inland Post Amendment (No. 65) Scheme, 2002


An Post, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983) hereby makes the following Scheme:

(1)       This Scheme may be cited as the Inland Post Amendment (No. 65 Scheme, 2002.

This Scheme shall come into operation on the 7th of May, 2002.

(2)       In this Scheme, “the Principal Warrant” means the Inland Post Warrant 1939

( S.I. No 202 of 1939 );

(3)       An Post may enter in such arrangements as it deems appropriate with any person for the affixing of post mark dyes to postal packets.

(4)       The Principal Warrant is hereby amended by the addition of the following regulation after Regulation 12:-

 12(a)     An Post may write, print or otherwise impress on any postal packet such words or figures or post mark dyes as it considers appropriate for any purpose it considers appropriate including without limitation, for revenue protection, quality control redirection or record purposes and for the purpose of advertising and publicity (including publicity for An Post's own services) and advertising in accordance with such arrangement as may be entered into between An Post and the advertiser.

(5)       An Post may, in its own interest and at its discretion, suspend, withhold or restrict any arrangement made pursuant to Regulation 4.

(6)       Neither the conclusion of an arrangement pursuant to Regulation 4 of this Scheme nor any document evidencing such an arrangement or issued in accordance therewith shall render An Post or any officer of An Post liable for any consequential loss arising directly or indirectly from a failure or delay in carrying out the arrangements.

(7)       An Post shall have no liability in respect of poor quality, or smudged or illegible post mark dyes.
