S.I. No. 288/2002 - Local Government (Superannuation) (Consolidation) (Amendment) Scheme, 2002

The Minister for the Environment and Local Government, in exercise of the power conferred on him by sections 2 and 5 of the Local Government (Superannuation) Act 1980 (No. 8 of 1980), with the consent of the Minister for Finance, hereby makes the following Scheme:

Short Title.

1. (1) This Scheme may be cited as the Local Government (Superannuation) (Consolidation) (Amendment) Scheme, 2002.

(2) This Scheme and the Local Government (Superannuation) (Consolidation) Scheme, 1998 ( S.I. No. 455 of 1998 ) shall be construed as one and may be cited together as the Local Government (Superannuation) (Consolidation) Scheme, 1998 to 2002.

Commencement.

2. (1) Article 4 shall be deemed to have come into force on the 29^th day of September, 1998 as respects the provisions of subparagraph (i) of the definition contained therein.

(2) Article 4 shall be deemed to have come into force on the 30^th day of January, 2001 as respects the provisions of subparagraph (ii) of the definition contained therein.

Interpretation.

3. In this Scheme:-

“the Principal Scheme” means the Local Government (Superannuation) (Consolidation) Scheme, 1998 ( S.I. No. 455 of 1998 ).

Amendment of article 3 of the Principal Scheme.

4. Article 3 of the Principal Scheme is hereby amended -

by the substitution of the following definition for the definition of “local authority” contained in sub-article (1) thereof:

‘ “local authority” shall have the meaning assigned to it in section 1 of the Local Government (Superannuation) Act, 1980 (No. 8 of 1980) and, in addition, shall include a body within the meaning of section 2(9) of that Act, subject to the provisos that —

(i) with effect from the 29^th day of September, 1998, it shall not include a vocational education committee as respects a person referred to in article 3(2) of the Vocational Education Superannuation Schemes (Transfer of Departmental Administration and Ministerial Functions) Order, 1998 ( S.I. No. 362 of 1998 ), and

(ii) with effect from the 30^th day of January, 2001, it shall not include a body referred to in article 3(2) of the Education Sector Superannuation Scheme (Transfer of Departmental Administration and Ministerial Functions) Order, 2001 ( S.I. No. 14 of 2001 );’.
