S.I. No. 366/2001 - District Court Areas (Amendment) (Christmas, Easter and August Sittings) Order, 2001.


The Courts Service, in exercise of the powers conferred on it by section 26 of the Courts of Justice Act, 1953 (No. 32 of 1953), as amended by section 43 of the Courts (Supplemental Provisions) Act, 1961 (No. 39 of 1961), section 16 of the Courts Act, 1971 (No. 36 of 1971) and section 29 of the Courts Service Act, 1998 (No. 8 of 1998) and after consultation with the President of the District Court, hereby orders as follows:

1.       (a)      This Order may be cited as the District Court Areas (Amendment) (Christmas, Easter and August Sittings) Order, 2001.

(b)      This Order shall come into operation on 1 August, 2001.

2.       Article 5 of District Court Areas (Amendment) Order, 1970 ( S.I. No. 161 of 1970 ) is amended by -

(a)      the substitution for paragraph (a) of the following paragraph -

“(a)    No scheduled sitting of the District Court as set out in the Principal Order shall be held in -

(i) the period of six consecutive days commencing on the Thursday - before Easter Day in each year,

(ii) the period of nine consecutive days commencing on the 23rd day of December in each year, and

(iii) the month of August in each year.”,

and

(b)      the insertion of the following paragraph immediately after paragraph (b) -

“(c)    Nothing in this order shall limit the powers conferred on a District Court Judge by section 27 of the Courts of Justice Act, 1953 (No.32 of 1953), or by rules of court.”.

3.       The Schedule to the District Court Areas (Amendment) Order, 1970 ( S.I. No. 161 of 1970 ), is amended by:-

(a)      the substitution at reference number 3 for the matter in column (3) of the following:

Westport: -

Each Wednesday at 11.00 a.m.

”,

(b)      the substitution at reference number 4 for the matter in column (3) of the following:

Harristown: -

Each Friday at 11.00 a.m.

Roscommon:-

Each Friday at 2.00 p.m.

”,

and

(c)      the substitution at reference number 18 for the matter in column (3) of the following:

Clonakilty: -

Each Friday at 2.00 p.m.

”.

4.       Business transacted in the District Court that is initiated and not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business had been initiated.

EXPLANATORY NOTE

This note does not form part of the instrument and is not a legal interpretation.

This order regulates the sittings of the District Court during the vacation periods of Christmas, Easter and the month of August and also provides for a change in the venue of the District Court sittings each August in District Number 3 from Castlebar to Westport and in District Number 18 from Bandon to Clonakilty.

It also changes the sittings of the District Court in District Number 4 each August to Harristown each Friday at 11.00 a.m. and Roscommon each Friday at 2.00 p.m.
