S.I. No. 290/2000 - Seanad Electoral (University Members) (Prescribed Matters) (Amendment) Regulations, 2000.


The Minister for the Environment and Local Government in exercise of the powers conferred on him by section 4 of the Seanad Electoral (University Members) Act, 1937 , (No. 30 of 1937) hereby makes the following Regulations:

1. These Regulations may be cited as the Seanad Electoral (University Members) (Prescribed Matters) (Amendment) Regulations, 2000.

2. The Seanad Electoral (University Members) (Prescribed Matters) Regulations, 1938 ( S.R. and O. No. 18 of 1938 ), the Seanad Electoral (University Members) (Prescribed Matters) (Amendment) Regulations, 1972 ( S.I. No. 201 of 1972 ) and these Regulations shall be construed as one and may be cited together as the Seanad Electoral (University Members) (Prescribed Matters) Regulations, 1938 to 2000.

3. The Seanad Electoral (University Members) (Prescribed Matters) Regulations, 1938 are hereby amended—

(a) by the substitution of the following article for Article 4:

“4. The fee to be paid under paragraph (d) of Rule 15 of the First Schedule to the Act by an applicant for a copy of the revised register or any part thereof shall be fifty-nine pence plus the sum of twelve pence for each one hundred by which the number of persons in the revised register or part thereof exceeds one hundred.”, and

(b) by the substitution of forms EU2 and EU3 in the Schedule hereto for forms EU2 and EU3 in the Schedule to the said Regulations, as amended by the Seanad Electoral Electoral (University Members) (Prescribed Matters) (Amendment) Regulations, 1972.

INSTRUCTIONS TO THE VOTER

1. The envelope received from the returning officer should contain the following documents, in addition to this form:

— an unmarked ballot paper and a small ballot paper envelope, and

— a larger covering envelope addressed to the returning officer.

2. You must produce to the person who will witness the declaration of identity:

(a) the envelope addressed to you by the returning officer,

(b) the unmarked ballot paper, and

(c) this form of declaration of identity, and

in the presence of the witness, sign this declaration of identity form and have it witnessed.

3. You must then:

(a) vote in secret,*

(b) put the marked ballot paper into the ballot paper envelope and close it,

(c) put the ballot paper envelope, and the completed declaration of identity into the larger covering envelope addressed to the returning officer and close it,

(d) post the covering envelope at once.

4. The time and day at which the poll closes at the election is specified on the ballot paper. Your completed voting documents must be with the returning officer by the specified time in order that your marked ballot paper may be included in the count. The ballot paper must be posted and cannot be handed to the returning officer.

— it indicates a first preference for more than one candidate, or

— it indicates a first preference and some other preference for the same candidate, or

— it has anything written or marked on it by which the voter could be identified.

These Regulations amend the Seanad Electoral (University Members) (Prescribed Matters) Regulations, 1938 by prescribing a revised scale of fees for the provision of copies of the register of electors, a revised form of ballot paper and revised notes to the form of declaration of identity for use at Seanad (University Members) elections.

* In order to vote, write 1 on the ballot paper opposite the name of the candidate of your first choice, 2 opposite the name of the candidate of your second choice, 3 opposite the name of the candidate of your third choice, and so on. A ballot paper will be void and not counted if—
