S.I. No. 429/1999 - Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 1999.


The Government, in exercise of the powers conferred on them by—

(a) section 3A (inserted by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973) (“the Act of 1973”), as amended by sections 6 , 8 and 9 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1983 (No. 32 of 1983) (the “Act of 1983”)), of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), and

(b) section 8A (inserted by section 11 of the Act of 1973, as amended by section 7 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977), and sections 6, 8 and 9 of the Act of 1983)), of the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938),

hereby order as follows:

1. This Order may be cited as the Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 1999.

2. In this Order—

“Act of 1938” means the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938);

“Act of 1973” means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973);

“Act of 1977” means the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977);

“Act of 1996” means the Oireachtas (Miscellaneous Provisions) and Ministerial and Parliamentary Offices (Amendment) Act, 1996 (No. 39 of 1996).

3. (1) The annual sum by way of salary payable monthly under subsection (1) (inserted by the Act of 1973) of section 3 of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), to each member of Dáil éireann, with effect from the 1st day of July, 1999, shall be £38,796.

(2) The annual sum by way of salary payable monthly under subsection (2) (inserted by the Act of 1973) of section 3 of the Oireachtas (Allowances to Members) Act, 1938 , to each member of Seanad éireann, with effect from the 1st day of July, 1999, shall be £24,549.

4. The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) or subsection (2) (inserted by the Act of 1977) of section 3 of the Act of 1938 shall be, with effect from the 1st day of July, 1999, a sum not exceeding—

(a) in the case of the Taoiseach— £74,631,

(b) in the case of the Tánaiste— £58,741,

(c) in the case of a member of the Government, other than the Taoiseach or the Tánaiste— £51,726, and

(d) in the case of a Minister of State appointed under section 1 of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 (No. 28 of 1977)— £23,234.

5. The annual sum by way of salary payable under section 4 (inserted by the Act of 1973) of the Act of 1938 to the Attorney General shall be, with effect from the 1st day of July, 1999, a sum not exceeding—

(a) in case the person who holds the office is not a member of either House of the Oireachtas— £90,523, and,

(b) in case a member of either House of the Oireachtas holds the office— £51,726.

6. (1) The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) of section 5 of the Act of 1938 shall be, with effect from the 1st day of July, 1999, a sum not exceeding—

(a) in the case of the Chairman of Dáil Éireann— £51,726, and

(b) in the case of the Deputy Chairman of Dáil Éireann— £23,234.

7. The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) of section 6 of the Act of 1938 shall be, with effect from the 1st day of July, 1999, a sum not exceeding—

(a) in the case of the Chairman of Seanad Éireann— £21,234, and

(b) in the case of the Deputy Chairman of Seanad Éireann— £11,530.

8. The annual sum by way of allowance for expenses payable under section 10 (inserted by section 5 of the Act of 1996) of the Act of 1938 shall be, with effect from the 1st day of July, 1999, a sum not exceeding—

(a) where payable under subsection (1)(a) of the said section 10— £29,073,

(b) where payable under subsection (1)(b) of the said section 10— £23,258,

(c) where payable under subsection (1)(c) of the said section 10— £11,628,

(d) where payable under subsection (1)(d) of the said section 10— £5,917,

and

(e) where payable under subsection (4) of the said section 10— £11,628.

This Order provides for an increase of 2%, in accordance with Clause 4 of the Annex to the Pay Agreement which forms part of Partnership 2000 for Inclusion, Employment and Competitiveness, to the salaries of members of the Houses of the Oireachtas, including Office Holders, with effect from 1 July, 1999 and to the sums payable to leaders of qualified parties and Independents in Dáil Éireann.
