S.I. No. 120/1999 - Land Commissioners' Pension Scheme (Amendment) Scheme, 1999.
I, CHARLIE McCREEVY, Minister for Finance, in exercise of the powers conferred on me by section 2 of the Superannuation and Pensions Act, 1976 (No. 22 of 1976), and the Public Service (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 81 of 1987 ), hereby make the following scheme: | ||||||||
1. (1) This Scheme may be cited as the Land Commissioners' Pension Scheme (Amendment) Scheme, 1999. | ||||||||
(2) The Principal Scheme and this Scheme may be cited together as the Land Commissioners' Pensions Schemes, 1979 and 1999, and shall be construed together as one. | ||||||||
2. In this Scheme “the Principal Scheme” means the Land Commissioners' Pensions Scheme, 1979 ( S.I. No. 217 of 1979 ). | ||||||||
3. The Principal Scheme is hereby amended by— | ||||||||
(a) the deletion in Article 3 of the definition of “the Minister for State”, and | ||||||||
(b) the substitution for “the Minister of State” of “the Minister” in each place where it occurs. | ||||||||
4. Where a Land Commissioner ceases to hold office by virtue of the dissolution of the Irish Land Commission— | ||||||||
(a) Article 5(1) of the Principal Scheme shall not apply to him, and | ||||||||
(b) the Minister shall grant to the Land Commissioner— | ||||||||
(i) a pension equal to one-eightieth of his salary multiplied by the aggregate of— | ||||||||
(I) the number of years of service he had as a Land Commissioner, | ||||||||
(II) the number of years between the 1st day of April, 1999, and the date he would attain the age of 67 years, and | ||||||||
(III) the total of those numbers less 10, | ||||||||
and | ||||||||
(ii) an additional lump sum, in addition to that granted under Article 6 of the Principal Scheme, equal to one and one-half times the amount of the pension. | ||||||||
