AQUACULTURE (LICENCE APPLICATION AND LICENCE FEES) (NO. 2) REGULATIONS, 1998.

I, MICHAEL WOODS, Minister for the Marine and Natural Resources, in exercise of the powers conferred on me by sections 63(1)(a) and 64 of the Fisheries (Amendment) Act, 1997 (No. 23 of 1997) (as adapted by the Marine (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 301 of 1997 )), and with the consent of the Minister for Finance, hereby make the following regulations:

1. (1) These Regulations may be cited as the Aquaculture (Licence Application and Licence Fees) (No. 2) Regulations, 1998.

(2) These Regulations shall come into operation on the 15th day of September, 1998.

2. In these Regulations—

"the Minister" means the Minister for the Marine and Natural Resources;

"the Schedule" means the Schedule to these Regulations.

3. (1) There shall be paid to the Minister in relation to an application—

(a) for a licence in respect of the culture of any aquatic plant or any form of aquatic food suitable for the nutrition of fish, a fee of£75, or

(b) for—

(i) the renewal of a licence, or

(ii) a review of a licence under section 70 of the Fisheries (Amendment) Act, 1997 ,

in respect of the culture of any aquatic plant or of any aquatic food suitable for the nutrition of fish, a fee of£50.

(2) Every fee received by the Minister under this Regulation shall be paid into, and be disposed of for the benefit of, the Exchequer in such a manner as the Minister for Finance shall direct.

4. There shall be paid to the Minister upon the granting of a licence for the culture on a land based site of any aquatic plant or of any aquatic food suitable for the nutrition of fish and thereafter upon each anniversary of the granting, while the licence is in force, a fee of£100.

5. There shall be paid to the Minister upon the granting of a licence and thereafter upon each anniversary of the granting, while the licence is in force, in respect of a marine based site of a class of culture mentioned in column (1) of the Schedule the fee specified in column (3) thereof opposite the method of calculation described in column (2) of the Schedule opposite the mention of the class.

EXPLANATORY NOTE.

These Regulations prescribe the fees payable in respect of applications for and the grant of aquaculture licences under the Fisheries (Amendment) Act, 1997 (No. 23) for the culture of any aquatic plant or of any form of aquatic food suitable for the nutrition of fish.
