EUROPEAN COMMUNITIES (BEET SEED) (AMENDMENT) REGULATIONS, 1997

 I, Ivan Yates, Minister for Agriculture, Food and Forestry, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 96/72/EC of 18 November 1996¹, in so far as it relates to beet seed, hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Beet Seed) (Amendment) Regulations, 1997 and shall come into operation on the 3rd day of February 1997.

(2) The European Communities (Beet Seed) Regulations, 1981 to 1991 and these Regulations may be cited together as the European Communities (Beet Seed) Regulations, 1981 to 1997 and shall be construed together as one.

2. (1) In these Regulations—

 "the Principal Regulations" means the European Communities (Beet Seed) Regulations, 1981 ( S.I No. 37 of 1981 );

3. Regulation 2 of the Principal Regulations is hereby amended

( a ) in paragraph (1)

(i) by the substitution of the following definition for the definition "small EEC

packages":

' "small EC packages" means packages containing the following seed:

( a ) certified seed which is monogerm or precision seed not exceeding

100,000 clusters or grains or a net weight of 2.5kg. excluding, where

contained in the package, granulated pesticides, pelleting substances

or other solid additives, or

( b ) certified seed, other than monogerm or precision seed, not exceeding

a net weight of 10kg. excluding, where contained in the package,

granulated pesticides, pelleting substances or other solid additives;

and

(ii) in paragraph (2) by the insertion after "13 June 1988" of "Council Directive No. 96/72/EC of 18 November 1996.".

4. Regulation 7 of the Principal Regulations is hereby amended -

( a ) in paragraph (1):

(i) by the substitution of "EC" for "EEC";

( b ) in paragraph (3):

(i) by the substitution of "EC" for "EEC";

 and

(c) in paragraph (4):

(i) by the substitution of "EC" for "EEC".

5. Regulation 8 of the Principal Regulations is hereby amended

( a ) in paragraph (1) before subparagraph (a):

(i) by the substitution of "EC" for "EEC";

and

( b ) in paragraph (4):

(i) by the substitution of "EC" for "EEC".

6. Regulation 10 of the Principal Regulations is hereby amended by the substitution of "EC" for "EEC".

7. Regulation 11 of the Principal Regulations is hereby amended by the substitution in paragraph (8) of the following definition for the definition "seed packer":

 ' "seed packer" means a person who in the course of business packs small EC packages '.

8. Annex III of the Schedule to the Principal Regulations is hereby amended

( a ) in paragraph A.1:

(i) by the substitution of "EC" for "EEC" in clause I,

and

( b ) in paragraph B

(i) by the substitution of "EC" for "EEC" in subparagraph 1.

Explanatory Note

This Regulation replaces the abbreviation "EEC" with "EC" with regard to packaging and

labelling of seeds.
