ALIENS (AMENDMENT) (NO. 3) ORDER, 1997

I, NORA OWEN, Minister for Justice, in exercise of the powers conferred on me by section 5 of the Aliens Act, 1935 (No. 14 of 1935), hereby order as follows:

1. (1) This Order may be cited as the Aliens (Amendment) (No. 3) Order, 1997.

(2) The collective citation "Aliens Orders, 1946 to 1997" shall include this Order.

(3) This Order shall come into operation on the 29th day of June, 1997.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. Paragraph (7) of Article 5 (inserted by the Aliens (Amendment) Order, 1975 ( S.I. No. 128 of 1975 )) of the Aliens Order, 1946 ( S. R. & O. No. 395 of 1946 ) is hereby amended by the substitution of the following subparagraph for subparagraph (a):

"(a) An immigration officer may examine an alien arriving in the State from Great Britain or Northern Ireland (referred to subsequently in this paragraph as "an alien to whom this paragraph applies") for the purpose of determining whether he or she should be given leave to land and the provisions of paragraphs (1) to (6) and (8) of this Article shall apply in the case of such a person as they apply in the case of a person coming from a place outside the State other than Great Britain or Northern Ireland with any necessary modifications.".

EXPLANATORY NOTE.

This Order has the effect of permitting Immigration Officers to carry out checks on persons arriving in the State from Great Britain or Northern Ireland.
