LOCAL GOVERNMENT (APPOINTMENT OF OFFICERS) (AMENDMENT), REGULATION 1997

The Minister for the Environment in exercise of the powers conferred on him by section 19 of the Local Government Act, 1941 (No. 23 of 1941 ), section 14 of the Local Government Act, 1955 (No. 9 of 1995) and section 48 of the Local Government Act, 1994 (No. 8 of 1994) hereby makes the following Regulations:

1. (i) These Regulations may be cited as the Local Government (Appointment of Officers) (Amendment) Regulations, 1997.

(ii) The Local Government (Appointment of Officers) (Amendment) Regulations, 1997 amend the Local Government (Appointment of Officers) Regulations, 1974 ( S.I. No. 61 of 1974 ) and these Regulations and the Local Government (Officers) Regulations, 1943 to 1984 shall be construed together and may be cited as the Local Government (Officers) Regulations 1943 to 1997.

2. These Regulations shall come into force on the 1st day of July, 1997.

3. Article 5 of the Local Government (Appointment of Officers) Regulations 1974 (S.I. 61 of 1974) is hereby amended by the substitution for paragraph (e) of the following:

"(e) Where, in relation to a class, description or grade of office specified in a direction under article 8 of these Regulations, a local authority decides that it is expedient that a vacant office be filled by appointment from among persons of a category, specified in the said direction, who are officers of, or persons employed by, the local authority or another local authority or a body with which an arrangement has been made for the purposes of this paragraph, the local authority may, subject to any limitations and conditions specified in directions under article 8 of these Regulations and without compliance with paragraphs (a), (b) and (c) of this article invite applications from such persons and select a person for appointment from among such applicants by means of a competition held in accordance with paragraph (d) of this article".

EXPLANATORY NOTE

These regulations replace paragraph (e) of Article 5 of the Local Government (Appointment of Officers) Regulations, 1974 and enable local authorities, subject to any limitations and conditions specified by the Minister for the Environment, to admit to confined competitions persons who are officers, or employees, of a local authority.
