EUROPEAN COMMUNITIES (PESTICIDE RESIDUES) (FRUIT AND VEGETABLES) (AMENDMENT) REGULATIONS, 1997.

 I, IVAN YATES, Minister for Agriculture, Food and Forestry, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive 93/58/EEC of 29 June 19931 and Council Directive 96/32/EC of 21 May, 19962, hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Pesticide Residues) (Fruit and Vegetables) (Amendment) Regulations, 1997 and shall come into operation on the 22nd day of May 1997.

(2) The European Communities (Pesticide Residues) (Fruit and Vegetables) Regulations, 1989 and these Regulations may be cited together as the European Communities (Pesticide Residues) (Fruit and Vegetables) Regulations, 1989 to 1997 and shall be construed together as one.

2. In Regulation 2 of the European Communities (Pesticide Residues) (Fruit and Vegetables) Regulations, 1989, the definition "Annex II" is amended by the deletion of the word "and" where it occurs in that definition and by inserting at the end of the definition the words "Council Directive 93/58/EEC of 29 June 1993(7) and Council Directive 96/32/EC of 21 May, 1996(8).". A footnote is added in the form "(7) O.J. No. L. 211/6 of 23 August 1993,(8) O.J. No. L. 144/12 of 18 June 1996.".

3. Annex II of the Schedule to the Principal Regulations is hereby amended:

( a ) by the deletion in Column I and Column 2 of the Table of the entries relating to the following pesticide residues:

amitrole;

atrazine;

binapacryl;

bromophos-ethyl;

captafol;

chlorbenside;

chlormequat, expressed as chlormequat cation;

DDT (sum of p.p'DDT; op'DDT; p.p'DDE and pp'TDE);

diazinon;

dichlorprop;

dicofol;

1,1dichloro2,2bis (4ethylphenyl) ethane;

dinoseb;

dioxathion;

endosulphan (sum of α and β—endosulphan and endosulphan sulphate);

endrin;

ethylene dibromide;

fenchlorphos and its oxygen analogue;

fentin compounds (sum expressed as fentin hydroxide);

heptachlor (sum of heptachlor and heptachlorepoxide);

maleic hydrazide;

paraquat, expressed as paraquat cation;

propoxur:

TEPP;

toxaphene;

2, 4, 5-T;

( b ) by the substitution in Column 2 of the Table opposite the mention of "methyl bromide" in Column 1

of "0.1: nuts, apricots, peaches, plums, figs and grapes" for "0.1: all products",

and

( c ) (i) by the insertion of the following entries in the Table in the Columns indicated:

 "The entries shall be deleted no later than 30 April 2000. If maximum residue levels are not adopted for the pesticide product combinations listed in Regulation 3 (c) by 30 April 2000, a maximum level of 0.05(*) shall be introduced for each of these pesticide product combinations in Directive 90/642/EEC.".

4. The European Communities (Pesticide Residues) (Fruit and Vegetables) (Amendment) Regulations, 1994 ( S.I. No. 189 of 1994 ) are hereby revoked.

EXPLANATORY NOTE.

These Regulations make technical amendments to residue controls for fruit and vegetables in the light of up to date scientific knowledge and revokes the European Communities (Pesticide Residues) (Fruit and Vegetables) (Amendment) Regulations, 1994.
