HARBOURS ACT, 1996 (STAFF OF DUN LAOGHAIRE HARBOUR COMPANY) REGULATIONS, 1997

I, SEÁN BARRETT, T.D., Minister for the Marine, in exercise of the powers conferred on me by subsections (1) and (5) of section 3 of the Harbours Act, 1996 (No. 11 of 1996), hereby make the following Regulations:

1. These Regulations may be cited as the Harbours Act, 1996 (Staff of Dun Laoghaire Harbour Company) Regulations, 1997.

2. These Regulations shall be deemed to have come into operation on the 3rd day of March, 1997.

3. In these Regulations—

"the Company" means Dun Laoghaire Harbour Company;

" the Department" means the Department of the Marine;

"the Minister" means the Minister for the Marine.

4. Section 38 of the Harbours Act, 1996 (No. 11 of 1996), shall, in respect of the period of 6 months beginning on the commencement of these Regulations, have effect subject to the following modifications, namely—

( a ) after the word "designated" in paragraph (b) there shall be inserted the words ", whether before, on or after the said vesting day,",

and

( b ) for the words "on the said vesting day", there shall be substituted the words "with effect from the said vesting day".

5. The Minister may, for such period as he or she determines (not being a period of more than 6 months beginning on the commencement of these Regulations), supply the services of one or more members of the staff of the Department to the Company upon such terms and conditions as the Minister determines.

6. A member of staff of the Department the services of whom are supplied to the Company under Regulation 5 of these Regulations shall, for the period that his or her services are so supplied, stand seconded from his or her duties as such a member but shall—

( a ) continue to receive the remuneration that he or she is entitled to receive as such a member,

and

( b ) continue to enjoy the rights which he or she enjoys, and be subject to the duties and liabilities to which he or she is subject, under the Civil Service Regulation Acts, 1956 to 1996, and every other enactment that applies to a civil servant within the meaning of the said Acts.

7. Subject to the terms and conditions upon which the services concerned are so supplied, a member of staff of the Department the services of whom are supplied to the Company under Regulation 5 of these Regulations shall, for the period that his or her services are so supplied, obey all lawful instructions given to him or her by the Company as respects the performance by him or her of those services.

EXPLANATORY NOTE.

These regulations empower the Minister for the Marine to designate staff of the Department of the Marine for employment with the Dun Laoghaire Harbour Company either before, on or after the vesting day of the company and to second staff from the Department to the Dun Laoghaire Harbour Company.
