S.I. No. 329/1996 - Energy (Miscellaneous Provisions) Act, 1996 (Section 14) (No. 2) Order, 1996


I, Michael Lowry, T.D., Minister for Transport, Energy and Communications, in exercise of the powers conferred on me by section 14 of the Energy (Miscellaneous Provisions) Act, 1995 (No. 35 of 1995), hereby make the following order:

1. This Order may be cited as the Energy (Miscellaneous Provisions) Act, 1995 (Section 14) (No. 2) Order, 1996.

2. All the fee simple interest of the Dublin Gas Company in the land described in the Schedule to this Order shall, on the 7th day of November, 1996, vest in Bord Gáis Éireann in fee simple subject to and with the benefit of the agreement referred to in the Second Schedule to this Order, but otherwise free from encumbrances.

FIRST SCHEDULE

ALL THAT the premises comprised in and conveyed by an Indenture of Conveyance made the 18th day of December, 1962 between P. O'Connor Limited (In Liquidation) of the First Part, Daniel Dominick Hampson of the Second Part, John Byrne of the Third Part, Carlisle Trusts Limited of the Fourth Part and Alliance and Dublin Consumers Gas Company of the Fifth Part the premises described as being the plot of ground granted by an Indenture of Conveyance dated the 16th day of June, 1820 and made between Isaac Mathew D'Olier, Frederick Darley and Abraham Bradley King three of the Wide Street Commissioners for the City of Dublin of the One Part and Robert Smyth of the Other Part and therein described as "ALL THAT AND THOSE that lot piece or parcel of ground situate lying and being on the north side of D'Olier Street containing in breadth in front to D'Olier Street aforesaid twenty two feet six inches or thereabouts in depth on the west side thereof forty three feet four inches or thereabouts thence turning to the north east side thirty four feet six inches or thereabouts and in depth on the east side thereof seventy two feet or thereabouts Bounded on the north and west by ground and premises belonging to the said Robert Smyth on the east by ground and premises demised by the said Commissioners to the Dublin Library Society and on the south by D'Olier Street aforesaid as the same is more particularly delineated laid down and described on the map or plan thereof hereon traced and situate lying and being in the County of the City of Dublin together with all and singular the rights members and appurtenances to the said hereby granted and released or hereby mentioned and intended to be granted and released premised belonging or in any wise appertaining" together with the house and premises known as 25 D'Olier Street erected thereon.

SECOND SCHEDULE

By Agreement made the 30th day of July, 1969 between Carlisle Trusts Limited of the One Part and Alliance and Dublin Consumers Gas Company of the Other part it was agreed, inter alia, that Alliance and Dublin Consumers Gas Company would convey to Carlisle Trusts Limited the freehold in possession free from encumbrances of ALL THAT the premises No. 25, D'Olier Street in the Parish of Saint Mark and City of Dublin (which land and premises were more particularly described on the plan attached to the said Agreement and thereon edged with a green line), and that Carlisle Trusts Limited would by way of exchange convenant to grant a lease to Alliance and Dublin Gas Consumers Company for 10,000 years at one shilling per annum (if demanded) of ALL THAT a portion of the premises known as 26, D'Olier Street in the Parish of Saint Mark and City of Dublin, which portion of the premises was hatched yellow on the ground floor and also on the basement of the plan attached to the said Agreement.

EXPLANATORY NOTE

This Order provides that the assets of a property in D'Olier Street, Dublin, which was owned by Dublin Gas Company (in receivership), be vested in Bord Gais Eireann.
