PACKAGE HOLIDAYS AND TRAVEL TRADE ACT, 1995 (OCCASIONAL ORGANISERS) REGULATIONS, 1995.

I, MICHAEL LOWRY, Minister for Transport, Energy and Communications, in exercise of powers conferred on me by section 3 of the Package Holidays and Travel Trade Act, 1995 (No. 17 of 1995) hereby make the following Regulations.

1. These Regulations may be cited as the Package Holidays and Travel Trade Act, 1995 (Occasional Organisers) Regulations, 1995.

2. The following classes of person are hereby specified as classes whose members may, subject to Regulation 3, be regarded as operating packages occasionally—

( a ) a professional, medical, scientific, cultural or trade association or society which organises a package, either directly or through an organising committee established for that purpose, during a conference, convention, meeting or seminar held in pursuance of aims and objectives of any such body,

( b ) a firm which organises a package for its employees,

( c ) a community, social, sporting or voluntary organisation which organises a package as part of the general objectives of that organisation, including a club or association operating within a firm,

( d ) a school or educational institution which organises a package for its teachers and students,

( e ) a religious or denominational group which organises a package involving a pilgrimage for members of that group, and

( f ) a package organised by a charitable or benevolent institution in pursuance of its objectives.

3. Where a package is one in respect of which a licence is required under the Transport (Tour Operators and Travel Agents) Act, 1982 or is one that is covered by arrangements which have been entered into for the purposes of that Act, a person shall not be regarded as organising any such package occasionally.

EXPLANATORY NOTE.

The effect of these Regulations is to specify the classes of persons who may be regarded as organising packages occasionally for the purpose of section 3 of the Act.
