COUNTY OF KERRY TRAFFIC AND PARKING (AMENDMENT) BYE-LAWS, 1995.

I, PATRICK J. CULLIGAN, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by sections 89 and 90 (as amended by section 6 of the Road Traffic Act, 1968 (No. 25 of 1968)) of the Road Traffic Act, 1961 (No. 24 of 1961) the Local Government (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 269 of 1977 ), with the consent of the Minister for the Environment and after consultation with the council of the county of Kerry, and the councils of the urban districts of Killarney, Listowel and Tralee hereby make the following bye-laws in respect of the area comprising the administrative county of Kerry, including the urban districts of Killarney, Listowel and Tralee:

1. These Bye-laws may be cited as the County of Kerry Traffic and Parking (Amendment) Bye-laws, 1995.

2. The County of Kerry Traffic and Parking Bye-laws, 1986 ( S.I. No. 184 of 1986 ) are hereby amended—

( a ) by the substitution of the following bye-law for bye-law 26 as amended by the County of Kerry Traffic and Parking (Amendment) Bye-laws, 1993 ( S.I. No. 327 of 1993 ).

"26 The fee for a parking disc shall be 20p except that in respect of the areas comprising the Urban districts of Killarney and Tralee the said fee shall be 40p".

( b ) by the substitution of the following bye-law for bye-law 37:

"37 (1) A resident's parking disc shall be issued by a local authority in respect of the parking of a vehicle in a disc parking place in the functional area of such local authority.

(2) The fee for a resident's parking disc shall be £5.

(3) A resident's parking disc shall be issued by a local authority in respect of the vehicle of which the resident is the owner and shall be valid for a period of one year from the date of issue, in respect of that vehicle and for the street or streets to which the disc relates".

EXPLANATORY NOTE.

These Bye-laws amend Bye-laws 26 of the County of Kerry Traffic and Parking Bye-laws 1986 ( S.I. No. 184 of 1986 ) as amended by the County of Kerry Traffic and Parking (Amendment) Bye-laws, 1993 ( S.I. No. 327 of 1993 ) to provide for an increase in the fee for a parking disc from 30p to 40p in the Urban district of Killarney and from 20p to 40p in the Urban district of Tralee. The fee for the rest of the county will remain at 20p.

Bye-law 27 is amended to reduce the fee for a resident's parking disc from £35.00 to £5.00.
