TELECOMMUNICATIONS (AMENDMENT) (NO. 2) SCHEME, 1995.

BORD TELECOM ÉIREANN in exercise of the powers conferred on it by Section 90 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983) hereby makes the following Scheme:

1. This Scheme may be cited as the Telecommunications (Amendment) (No. 2) Scheme, 1995.

2. (1) The collective citation "the Telecommunications Schemes, 1994 and 1995" includes this Scheme.

(2) This Scheme shall come into operation on 26 April, 1995 with the exception of Article 4 (e) which shall be deemed to have come into operation on 3 April, 1995, Article 4 (f) which shall be deemed to have come into operation on 1 April, 1995 and Article 4 (g) which shall come into operation on 1 May, 1995.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Scheme.

4. The Telecommunications Scheme, 1994, ( S.I. No. 177 of 1994 ) is hereby amended by:

( a ) the substitution of the following Article for article 18 (2):

"18 (2) For the purpose of this Scheme. "Eligible International Volume Discount Calls" shall mean subscriber dialled calls made to telephones outside the State (excluding Northern Ireland) made from a telephone exchange line rented by a subscriber but excluding subscriber dialled calls made by use of the Switched Digital International facility and also excluding Chargecard calls, Eircell calls, Eirpac calls and unrestricted 64Kb calls made by use of the Integrated Services Digital Network facility.

( b ) the substitution of the following Article for Article 58:

"58. (1) In respect of every subscriber dialled trunk call, including calls made to Eircell equipment (except Chargecard calls and calls made by use of the Ireland Direct facility) made from a telephone exchange line there shall be charged to the telephone subscriber and paid by him a charge calculated in accordance with Part 3 of the First Schedule to this Scheme.

(2) In respect of every chargecard call and calls made by use of the Ireland Direct facility there shall be charged to the telephone subscriber and paid by him a charge calculated in accordance with Part 3A of the First Schedule to this Scheme.

(3) In respect of every subscriber dialled trunk call, including calls made to Eircell equipment, made from a public telephone there shall be charged or placed in the public telephone or otherwise credited to Bord Telecom Éireann in such manner as it may from time to time prescribe a sum calculated in accordance with Part 3A of the First Schedule to the Scheme.

(4) In respect of every subscriber dialled trunk call, including calls made to Eircell equipment, made from a Cardphone public telephone, there shall be charged to the telephone subscriber and paid by him a charge calculated in accordance with Part 3 A of the First Schedule to this Scheme.

( c ) the substitution of the following Part 3 of the First Schedule for Part 3 of the First Schedule thereto:
