S.I. No. 7/1994 - European Communities (Materials and Articles Intended To Come Into Contact With Foodstuffs) (Amendment) Regulations, 1994.


I, RUAIRÍ QUINN, Minister for Enterprise and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive No. 92/15/EEC1 of 11 March, 1992, hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Materials and Articles intended to come into Contact with Foodstuffs) (Amendment) Regulations, 1994.

(2) These Regulations together with the European Communities (Materials and Articles intended to come into Contact with Foodstuffs) (Amendment) Regulations, 1993 ( S.I. No. 295 of 1993 ) and the European Communities (Materials and Articles intended to come into Contact with Foodstuffs) Regulations, 1991 ( S.I. No. 307 of 1991 ) may be cited together as the European Communities (Materials and Articles intended to come into Contact with Foodstuffs) Regulations, 1991 to 1994.

(3) These Regulations shall come into operation on the 28th day of February, 1994.

2. In these regulations—

"the Principal Regulations" means the European Communities (Materials and Articles intended to come into Contact with Foodstuffs) Regulations, 1991 ( S.I. No. 307 of 1991 ).

3. (1) Regulation 2 of the Principal Regulations is hereby amended by the substitution of the following definition for the definition of "Commission Directives" therein—

"Commission Directives" means Commission Directive 80/590/EEC2, Commission Directive 80/766/EEC3, Commission Directive 86/388/EEC4, Commission Directive 90/128/EEC5, Commission Directive 92/39/EEC6 and Commission Directive 92/15/EEC7;

(2) Regulation 7 of the Principal Regulations is hereby amended—

( a ) by the insertion in paragraph (3) (d) (i), after "83/229/EEC" of "as amended by Article 1 of Commission Directive No. 92/15/EEC of 11 March, 1992";

( b ) by the addition of the following paragraphs—

"(6) No person shall place on the market materials and articles made of regenerated cellulose film unless they are accompanied by written declaration attesting that they comply with the provisions laid down by Article 6 (5) of Council Directive No. 89/109/EEC of 21 December, 1988.

(7) paragraph (6) of this Regulation does not apply to regenerated cellulose film which, by its nature, is clearly intended to come into contact with foodstuffs.

(8) From 1 July, 1994 a person shall not engage in trade in or in use of regenerated cellulose film which does not conform to Council Directive No. 83/229/EEC of 25 April, 1983.".

EXPLANATORY NOTE.

The purpose of these Regulations is to give legal effect to Commission Directive 92/15/EEC of 11 March, 1992 amending Council Directive 83/229/EEC on the approximation of the laws of the Member States relating to materials and articles made of regenerated cellulose film intended to come into contact with foodstuffs and also for the administration and enforcement of the Regulations.
