EUROPEAN COMMUNITIES (CONSERVATION OF WILD BIRDS) (AMENDMENT) REGULATIONS, 1994.

I, BERTIE AHERN, Minister for Finance, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), for the purpose of giving further effect to Council Directive No. 79/409/EEC of 2 April, 19791, hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Conservation of Wild Birds) (Amendment) Regulations, 1994.

(2) These Regulations shall come into operation on the 24th day of March, 1994.

2. In these Regulations "the foreshore area" means the bed and shore, below the line of high water of ordinary or medium tides, of the sea and of every tidal river and tidal estuary and of every channel, creek and bay of the sea or of any such river or estuary.

3. The Schedule to the European Communities (Conservation of Wild Birds) Regulations, 1985 ( S.I. No. 291 of 1985 ), is hereby amended by the addition of the following paragraphs after paragraph 13:

"14. Ballycotton Bay in the county of Cork.

The area of foreshore situated in Ballycotton Bay in the county of Cork bounded by the high water mark enclosed on the map in Schedule 1 to these Regulations within the inner margin of the black line and hatched thereon in black.

15. Ballymacoda Bay in the county of Cork.

The area of foreshore situated in Ballymacoda Bay in the county of Cork bounded by the high water mark enclosed on the map in Schedule 2 to these Regulations within the inner margins of the black line and hatched thereon in black.

16. Sanydmount Strand and the Tolka Estuary in the county of Dublin.

The areas of foreshore situated in Sandymount Strand and the Tolka Estuary bounded by the high water mark enclosed on the map in Schedule 3 to these Regulations within the inner margin of the black line and hatched thereon in black.

17. Broadmeadow Estuary and the Malahide Estuary in the county of Dublin.

The areas of foreshore situated in the Broadmeadows Estuary and the Malahide Estuary bounded by the high water mark enclosed on the map in Schedule 4 to these Regulations within the inner margin of the black line and hatched thereon in black.

18. Dundalk Bay in the county of Louth.

The area of foreshore situated in Dundalk Bay bounded by the high water mark enclosed on the map in Schedule 5 to these Regulations within the inner margin of the black line and hatched thereon in black.".

EXPLANATORY NOTE.

EEC Directive No. 79/409 on the conservation of wild Birds provides for the conservation of populations of wild birds by among other things, classifying important ornithological sites as Special Protection Areas for them. The effect of these Regulations is to classify five sites as Special Protection Areas in accordance with Article 4 of the Directive and to provide that contravention of the provisions of these Regulations shall constitute an offence.
