MEMBERS OF THE OIREACHTAS AND MINISTERIAL AND PARLIAMENTARY OFFICES (ALLOWANCES AND SALARIES) ORDER, 1994.

The Government, in exercise of the powers conferred on them by section 3A of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938) (inserted by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by sections 6 , 8 and 9 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1983 (No. 32 of 1983), and section 8A of the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938) (inserted by section 11 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by section 7 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977) and sections 6 , 8 and 9 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1983 (No. 32 of 1983), hereby make the following Order.

1. This Order may be cited as the Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 1994.

2. In this Order—

"the Act of 1938" means the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938);

"the Act of 1973" means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973);

"the Act of 1977" means the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977).

3. (1) The annual sum by way of salary payable monthly under subsection (1) (inserted by the Act of 1973) of section 3 of the Oireachtas (Allowances to Members) Act, 1938 , to each member of Dáil Éireann shall be deemed to have been £32,059 per annum with effect from the 1st day of April, 1994.

(2) The annual sum by way of salary payable monthly to each member of Seanad Éireann under subsection (2) (inserted by the Act of 1973) of section 3 of the Oireachtas (Allowances to Members) Act, 1938 shall be, and where appropriate shall be deemed to have been, £19,104 per annum with effect from the 1st day of April, 1994, and £20,710 per annum with effect from the 1st day of May, 1995.

4. The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) or subsection (2) (inserted by the Act of 1977) of section 3 of the Act of 1938 shall be, and where appropriate shall be deemed to have been, a sum not exceeding—

( a ) in the case of the Taoiseach, £55,758 per annum with effect from the 1st day of April, 1994, and £63,220 per annum with effect from the 1st day of May, 1995.

( b ) in the case of the Tánaiste, £43,182 per annum with effect from the 1st day of April, 1994, and £49,594 per annum with effect from the 1st day of May, 1995.

( c ) in the case of a member of the Government, other than the Taoiseach or the Tánaiste, £37,885 per annum with effect from the 1st day of April, 1994, and £43,600 per annum with effect from the 1st day of May, 1995.

( d ) in the case of a Minister of State appointed under section 1 of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 (No. 28 of 1977), £18,463 per annum with effect from the 1st day of April, 1994, and £19,620 per annum with effect from the 1st day of May, 1995.

5. The annual sum by way of salary payable under section 4 (inserted by the Act of 1973) of the Act of 1938 to the Attorney General shall be, and where appropriate shall be deemed to have been, a sum not exceeding—

( a ) in case the person who holds the office is not a member of either House of the Oireachtas, £69,353 per annum with effect from the 1st day of April, 1994, and £76,300 per annum with effect from the 1st day of May, 1995.

( b ) in case a member of either House of the Oireachtas holds the office, £37,885 per annum with effect from the 1st day of April, 1994, and £43,600 per annum with effect from the 1st day of May, 1995.

6. (1) The annual sum by way of salary payable under subsection (1) (inserted by the Act of 1973) of section 5 of the Act of 1938 to the Chairman of Dáil Éireann shall be, and where appropriate shall be deemed to have been, a sum not exceeding £37,885 per annum with effect from the 1st day of April, 1994, and £43,600 per annum with effect from the 1st day of May, 1995.

(2) The annual sum by way of salary payable under section 5 (1) of the Act of 1938 to the Deputy Chairman of Dáil Éireann shall be, and where appropriate shall be deemed to have been, a sum not exceeding £18,463 per annum with effect from the 1st day of April, 1994, and £19,620 per annum with effect from the 1st day of May, 1995.

7. The annual sums payable under section 9A (inserted by the Act of 1973) and section 10 (as amended by the Act of 1973) of the Act of 1938 by way of allowance for expenses, shall be, and where appropriate shall be deemed to have been—

( a ) in the case of the sum payable under subsection (1) of the said section 9A, £136,546 per annum with effect from the 1st day of April, 1994, and £144,500 per annum with effect from the 1st day of May, 1995,

( b ) in the case of the sum payable under paragraph (a) of subsection (2) of the said section 9A, £95,659 per annum with effect from the 1st day of April, 1994, and £101,231 per annum with effect from the 1st day of May, 1995,

( c ) in the case of the sum payable under paragraph (b) of subsection (2) of the said section 9A, £41,145 per annum with effect from the 1st day of April, 1994, and £43,542 per annum with effect from the 1st day of May, 1995,

( d ) in the case of the sum payable under paragraph (a) of subsection (3) of the said section 9A, £68,403 per annum with effect from the 1st day of April, 1994, and £72,387 per annum with effect from the 1st day of May, 1995,

( e ) in the case of the sum payable under paragraph (b) of subsection (3) of the said section 9A, £68,403, divided in the manner specified in that paragraph, with effect from the 1st day of April, 1994, and £72,387, divided in the manner specified in that paragraph, with effect from the 1st day of May, 1995,

( f ) in the case of the sum payable under subsection (1) of the said section 10, £340,972 per annum with effect from the 1st day of April, 1994, and £360,833 per annum with effect from the 1st day of May, 1995,

( g ) in the case of the sum payable under paragraph (a) of subsection (2) of the said section 10, £270,851 per annum with effect from the 1st day of April, 1994, and £286,628 per annum with effect from the 1st day of May, 1995,

( h ) in the case of the sum payable under paragraph (b) of subsection (2) of the said section 10, £134,564 per annum with effect from the 1st day of April, 1994, and £142,402 per annum with effect from the 1st day of May, 1995,

( i ) in the case of the sum payable under paragraph (a) of subsection (3) of the said section 10, £195,356 per annum with effect from the 1st day of April, 1994, and £206,735 per annum with effect from the 1st day of May, 1995, and

( j ) in the case of the sum payable under paragraph (b) of subsection (3) of the said section 10, £220,098, divided in the manner specified in that paragraph, with effect from the 1st day of April, 1994, and £232,919, divided in the manner specified in that paragraph, with effect from the 1st day of May, 1995.

EXPLANATORY NOTE.

This Order applies the increases recommended in Report No. 35 of the Review Body on Higher Remuneration in the Public Sector to the salaries of members of the Houses of the Oireachtas, including office-holders, with effect from 1 April, 1994 and 1 May, 1995. The Order also provides for increases in the sums payable to leaders of qualified parties in Dáil Éireann.
