COURTS (SUPPLEMENTAL PROVISIONS) ACT, 1961 (SECTION 46) ORDER, 1994

The Government, in exercise of the powers conferred on them by section 46 (9) of the Courts (Supplemental Provisions) Act, 1961 (No. 39 of 1961) (inserted by section 1 of the Courts (Supplemental Provisions) (Amendment) (No. 2) Act, 1968 (No. 21 of 1968)), as amended by sections 8 and 9 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1983 (No. 32 of 1983), hereby make the following order:

1. This Order may be cited as the Courts (Supplemental Provisions) Act, 1961 (Section 46) Order, 1994.

2. The annual sums payable by way of remuneration under subsections (1), (2), (3) and (9) which subsections were inserted by the Courts (Supplemental Provisions) (Amendment) (No. 2) Act, 1968 (No. 21 of 1968)) of section 46 of the Courts (Supplemental Provisions) Act, 1961 (No. 39 of 1961), to the Chief Justice and each ordinary judge of the Supreme Court, the President of the High Court and each ordinary judge of the High Court, the President of the Circuit Court and each ordinary judge of the Circuit Court and the President of the District Court and each other judge of the District Court shall, with effect from the dates specified, be and where appropriate shall be deemed to have been—

( a ) to the Chief Justice—

(i) £87,228 with effect from 1st day of April 1994,

(ii) £95,920 with effect from 1st day of May 1995;

( b ) to the President of the High Court—

(i) £78,291 with effect from 1st day of April 1994,

(ii) £86,109 with effect from 1st day of May 1995;

( c ) to each ordinary Judge of the Supreme Court—

(i) £75,213 with effect from 1st day of April 1994,

(ii) £82,840 with effect from 1st day of May 1995;

( d ) to each ordinary Judge of the High Court—

(i) £69,353 with effect from 1st day of April 1994,

(ii) £76,300 with effect from 1st day of May 1995;

( e ) to the President of the Circuit Court—

(i) £69,353 with effect from 1st day of April 1994,

(ii) £76,300 with effect from 1st day of May 1995;

( f ) to each ordinary Judge of the Circuit Court—

(i) £53,249 with effect from 1st day of April 1994,

(ii) £56,680 with effect from 1st day of May 1995;

( g ) to the President of the District Court—

(i) £53,249 with effect from 1st day of April 1994,

(ii) £56,680 with effect from 1st day of May 1995;

( h ) to each other Judge of the District Court—

(i) £44,313 with effect from 1st day of April 1994,

(ii) £46,870 with effect from 1st day of May 1995.

EXPLANATORY NOTE.

This Order applies to the salaries of the Judiciary the increases recommended in Report No. 35 of the Review Body on Higher Remuneration in the Public Sector dated 30 January, 1992 which will be phased in as follows:—

—50% with effect from 1 April, 1994 and 50% with effect from 1 May, 1995 and will be up-rated, having regard to the General Wage Round increases of I June, 1994 and with regard to the 1995, 1996 and 1997 revisions under Clause 2 of the Agreement on Pay, Conditions of Employment and Co-operation at the level of the Enterprise, which forms part of the Programme for Competitiveness and Work.
