TELECOMMUNICATIONS (AMENDMENT) SCHEME, 1994.

BORD TELECOM ÉIREANN in exercise of the powers conferred on it by Section 90 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), hereby makes the following Scheme:

1. This Scheme may be cited as the Telecommunications (Amendment) Scheme, 1994.

2. The collective citation "the Telecommunications Schemes, 1992 to 1994" includes this Scheme.

3. (i) This Scheme, in so far as it reduces the Annual Rental Charge for the International Virtual Private Network facility shall be deemed to have come into operation on 1 December 1993.

(ii) This Scheme, in so far as it reduces tariffs in respect of certain subscriber dialled trunk calls shall come into operation on 1 April 1994.

(iii) This Scheme, in so far as it provides for matters other than those mentioned in paragraphs (i) and (ii) of this Article, shall come into operation on 1 February 1994.

4. The Interpretation Act 1937 (No. 38 of 1937), applies to this Scheme.

5. The Telecommunications Scheme, 1992 ( S.I. No. 19 of 1992 ) is hereby amended by:

( a ) the insertion of the following Article after Article 17 thereof:

"17A (1) Bord Telecom Éireann may, where the amount otherwise due (exclusive of Value Added Tax) on a single telephone account in respect of Eligible Calls exceeds the appropriate amount specified in Section VII of Part 6 of the First Schedule to this Scheme, apply thereto a discount (hereinafter "International Volume Discount") in respect of such amounts. The International Volume Discount shall be calculated as set out in Section VII of Part 6 of the First Schedule to this Scheme. Bord Telecom Éireann may at its absolute discretion withdraw the International Volume Discount from any subscriber.

(2) For the purposes of this Scheme, "Eligible Calls" shall mean subscriber dialled calls made to telephones outside the State (excluding Northern Ireland) made from a telephone exchange line rented by the subscriber but excluding subscriber dialled calls made by use of the International Virtual Private Network facility, or the Switched Digital International facility and also excluding Chargecard calls, Eircell calls and Eirpac calls.

(3) It shall be a condition of the application of the International Volume Discount that:

(i) Eligible Calls shall be made only from a single premises, occupied by the subscriber; and

(ii) Eligible Calls shall be made by the subscriber or by employees of the subscriber; and

(iii) accounts to which the International Volume Discount applies must be discharged in full within 14 days or by means of direct debit mandate approved by Bord Telecom Éireann.";

( b ) the insertion of the following Article after Article 32 thereof:

"32A Where a subscriber makes a call to a network operated by a person other than Bord Telecom Éireann, the duration of a call for charging purposes may be calculated with effect from the instant of connection to such network, whether or not the call is answered by the called party.";

( c ) the addition of the following paragraph (13) to Article 62 thereof:

"(13) Bord Telecom Éireann may provide a facility (in this Scheme referred to as the "Integrated Switched Digital Network" facility) to telephone subscribers generally or to such groups of telephone subscribers as it shall determine, whereby a telephone subscriber may make telephone calls over switched end to end digital transmission paths. There shall be charged to the subscriber and paid by him in respect of the Integrated Switched Digital Network facility the appropriate charge specified in Section VIII of Part 6 of the First Schedule to this Scheme.";

( d ) the substitution of the following paragraph 2, for paragraph 2 of Section IV of Part 6 of the First Schedule thereto:

"2. Annual Rental Charge, £960.00.";

( e ) the substitution of the following paragraph 1(i) for paragraph 1(i) of Part 3 of the First Schedule thereto:

EXPLANATORY NOTE.

The purpose of this Scheme is to provide for the introduction of International Volume Discounts, Integrated Switched Digital Network facilities, a reduction in tariffs for certain other services and to effect certain other modifications to the Telecommunications Scheme, 1992.
