HARBOUR RATES (DINGLE HARBOUR) ORDER, 1993.

I, DAVID ANDREWS, Minister for the Marine, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), on the application of Dingle Harbour Commissioners and after due compliance with section 106 of the said Act, hereby order as follows:—

1. (1) This Order may be cited as the Harbour Rates (Dingle Harbour) Order, 1993.

(2) This Order shall come into operation on the 10th day of April, 1993.

2. In this Order—

"week", in relation to tonnage rates, means any period of seven consecutive days, or part thereof.

"an entry into the harbour", in relation to a boat or vessel, means a stay by the boat or vessel in Dingle Harbour for a period of seven days or less.

"fish" has the same meaning as in the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959) as amended by the Fisheries (Amendment) Act, 1978 (No. 18 of 1978).

3. Where rates fixed under this Order are chargeable by reference to metric tonnage, weights of less than 1 metric tonne shall be chargeable as follows:—

( a ) any weight not exceeding 250 kilogrammes shall be charged as 250 kilogrammes,

( b ) any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall be charged as 500 kilogrammes,

( c ) any weight exceeding 500 kilogrammes but not exceeding 750 kilogrammes shall be charged as 750 kilogrammes,

( d ) any weight exceeding 750 kilogrammes but not exceeding 1 metric tonne shall be charged as 1 metric tonne.

4. The Harbour Rates (Dingle Harbour) Order, 1943 ( S. R. & O. No. 83 of 1943 ), is hereby revoked.

The tonnage of a vessel upon which Tonnage Rates shall be based and chargeable mentioned at Reference Numbers 1 and 2 of this Schedule shall be the Net Register Tonnage or fifty per cent of the Gross Register Tonnage of the vessel concerned whichever is greater.

(a) £35 for an entry into the harbour, or

(b) £350 plus £2 per GRT for 12 months payable in advance. (£380 to £550)

7.

Over 100 GRT

(a) £50 for an entry into the harbour, or

(b) £550 plus £1 per GRT for 12 months payable in advance.

The above rates are compounded rates for all fishing vessels with the exception of those engaged in herring and mackerel fishing.

Fishing vessels laid up and not paying the annual rates prescribed above will be liable for the charges in Reference 2 of this Schedule.

Advance payments of Harbour Dues will be made on 1st October each year.

Passenger Vessels

8.

Boats with a permitted complement of up to 12 passengers

£270 per annum.

9.

Boats with a permitted complement of up to 20 passengers

£390 per annum.

10.

Boats with a permitted complement of up to 50 passengers

£730 per annum.

11.

Boats with a permitted complement of between 50 and 100 passengers

£25 per entry per boat or £2,500 per annum per boat payable on each May 1st

12.

Boats with a permitted complement of over 100 passengers.

£40 per entry per boat or £4,000 per annum per boat payable on each May 1st

A compounded rate may be applied in agreement with Associations or Companies or groups of boat operators operating within the harbour. This rate can include above charges and additional charges for the provision of certain passenger facilities (e.g. pontoon and premises). The compounded rate will be subject to approval by the Minister for the Marine in accordance with Section 100 of the Harbours Act, 1946 .

Pleasure Craft

13. Dingle Marina charges will apply to all pleasure craft berthing at the Town Piers or Town Marina or mooring inside the breakwaters. Rates to be fixed annually by Dingle Harbour Commissioners in accordance with Section 55 of the Harbours Act, 1946 .

Marina Charges will include Harbour Dues.

Notes:

1. Herring and Mackerel: A consolidated charge, set each season between the Commissioners, Fishermen and Fish buyers may be levied on fishing vessels and landings of Herring or Mackerel. This charge may be levied on vessels landing fish, fish sellers and fish buyers and will be instead of single entry rates. The consolidated rate will be subject to approval by the Minister for the Marine in accordance with Section 100 of the Harbours Act, 1946 .

2. An ad valorem rate (in lieu of goods and tonnage rates) of 1.25% may apply for all fishing vessels landing at Dingle. The ad valorem rate may be applied at the discretion of the Commissioners and with the consent of the Minister for the Marine.

THIRD SCHEDULE

Other Actual Rates

Moorings

All moorings laid in the harbour will be at the discretion of the Harbour Master and will be registered and recorded on a chart of the harbour. An annual charge of £50 in addition to harbour dues will apply to each mooring.

Water

Water may be charged for at a rate which includes service charge.

Water charge per tonne............................................................ ............72p.

A minimum water charge of £25 may be charged for vessels over 100 GRT each time water is taken.

Electricity

As per coin operated metered charge.

Designated Ice and Landing Berths

An additional charge of £35 per day will apply to vessels occupying designated ice or landing berths, or overstaying in these berths, without the permission of the Harbour Master, for purposes other than landing fish or cargo, or taking ice on board.

Slipways A charge of £20 per day for every day in excess of three days will apply to vessels occupying any slipway.

EXPLANATORY NOTE.

This Order authorises the Dingle Harbour Commissioners to charge revised goods, tonnage and service rates at Dingle Harbour.
