DATA PROTECTION COMMISSIONER SUPERANNUATION SCHEME, 1993.

I, MÁIRE GEOGHEGAN-QUINN, Minister for Justice, in exercise of the powers conferred on me by section 9 and paragraph 7 (a) of the Second Schedule to the Data Protection Act, 1988 (No. 25 of 1988), and with the consent of the Minister for Finance, hereby make the following scheme.

1. This Scheme may be cited as the Data Protection Commissioner Superannuation Scheme, 1993.

2. Any person who, immediately prior to being appointed Data Protection Commissioner, was serving in an established position in the civil service (within the meaning of the Civil Service Regulation Act, 1956 (No. 46 of 1956)), shall have the terms of the Superannuation Acts, 1834 to 1963, and the Superannuation and Pensions Act, 1976 , applied to him on the cessation of his appointment as Commissioner as if he were an established civil servant on that date, and, for the purposes of the application of the said Superannuation Acts to such a person, his service as Commissioner shall be deemed to be service as a civil servant.

EXPLANATORY NOTE.

This scheme provides for the grant of pensions, lump sums or other allowances on retirement or death to or in respect of persons who have held the office of Data Protection Commissioner and who, immediately prior to being appointed to that office, were serving in an established position in the civil service.
