EUROPEAN COMMUNITIES (THERAPEUTIC SUBSTANCES ACT, 1932) (CESSER OF APPLICATION) REGULATIONS, 1992.

The Minister for Health in exercise of the powers conferred on him by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby makes the following Regulations:—

1. These Regulations may be cited as the European Communities ( Therapeutic Substances Act, 1932 ) (Cesser of application) Regulations, 1992.

2. These Regulations shall come into operation on 1st day of January, 1993.

3. The Therapeutic Substances Act, 1932 (No. 25 of 1932) as adopted by Article 4 (1) of the Health (Transfer of Departmental Administration and Ministerial Functions) Order, 1947 (S.R. and O. 1947 No. 58) shall cease to apply to therapeutic substances for human use.

EXPLANATORY NOTE.

The purpose of these Regulations is to cease the application of the Therapeutic Substances Act, 1932 to therapeutic substances for human use. The substances concerned are already controlled under the Medical Preparations (Licensing, Advertising and Sale) Regulations, 1984 ( S.I. No. 210 of 1984 ) for the purpose of E.C. Council Directives on immunological medicinal products (89/342/EEC) and on medicinal products derived from human blood or human plasma (89/381/EEC).
