LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) (FEES) (AMENDMENT) REGULATIONS, 1992.

The Minister for the Environment, in exercise of the powers conferred on him by section 10 of the Local Government (Planning and Development) Act, 1963 (No. 28 of 1963) and by section 10 of the Local Government (Planning and Development) Act, 1982 (No. 21 of 1982), and with the consent of the Minister for Finance, hereby makes the following Regulations:—

1 Citation.

1. (1) These Regulations may be cited as the Local Government (Planning and Development) (Fees) (Amendment) Regulations, 1992.

(2) These Regulations and the Local Government (Planning and Development) Regulations, 1977 to 1991 may be cited together as the Local Government (Planning and Development) Regulations, 1977 to 1992.

2 Commencement.

2. (1) These Regulations shall come into operation on the 17th day of February, 1992.

(2) Notwithstanding the provisions of these Regulations, where an appeal, a reference, a request for a determination to which article 21 of the 1984 Regulations applies or submissions or observations is or are received by the Board prior to the coming into operation of these Regulations, the fee to be paid to the Board shall be the fee payable under the 1984 Regulations as amended by the 1989 Regulations.

3 Interpretation.

3. In these Regulations—

"appeal", "the Board" and "reference" have the meanings assigned to them by article 3 (6) of the 1984 Regulations;

"the 1984 Regulations" means the Local Government (Planning and Development) (Fees) Regulations, 1984 ( S.I. No. 358 of 1984 );

"the 1989 Regulations" means the Local Government (Planning and Development) (Fees) (Amendment) Regulations, 1989 ( S.I. No. 338 of 1989 ).

4 Amendment of 1984 Regulations.

4. The 1984 Regulations, as amended by the 1989 Regulations, are hereby amended by the substitution for the Third Schedule thereto of the Schedule to these Regulations.

EXPLANATORY NOTE.

These Regulations revise, with effect from 17 February, 1992, the fees payable to An Bord Pleanala in respect of appeals, references and related matters.
