EUROPEAN COMMUNITIES (RECOGNITION OF QUALIFICATIONS IN VETERINARY MEDICINE) (AMENDMENT) REGULATIONS, 1992

I, JOE WALSH, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to the amendment and extension of Council Directive No. 78/1026/EEC of 18 December, 19781 and Council Directive No. 78/1027/EEC of the said 18 December2 by Council Directive No. 89/594/EEC of 30th October, 1989,3 and Council Directive 90/658/EEC of 4 December 19904 hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Recognition of Qualifications in Veterinary Medicine) (Amendment) Regulations, 1992.

(2) The European Communities (Recognition of Qualifications in Veterinary Medicines) Regulations, 1980 to 1987, and these Regulations may be cited together as the European Communities (Recognition of Qualifications in Veterinary Medicine) Regulations, 1980 to 1992.

2. In these Regulations "the Principal Regulations" means the European Communities (Recognition of Qualifications in Veterinary Medicine) Regulations, 1980 ( S.I. No. 391 of 1980 ).

3. (1) Paragraphs (c) and (d) of section 31 (1) of the Veterinary Surgeons Act, 1931 (No. 36 of 1931), inserted by Regulation 4(1) of the Principal Regulations, as extended by the provisions of Regulation 3 of the European Communities (Recognition of Qualifications in Veterinary Medicine) (Amendment) Regulations, 1982 ( S.I. No. 323 of 1982 ) and Regulation 3 of the European communities (Recognition of Qualifications in Veterinary Medicine) (Amendment) Regulations, 1987 ( S.I. No. 159 of 1987 ), shall be construed and have effect having regard and subject to the provisions of:

Articles 16, 17, 18, 19 and 20 of Council Directive No. 89/594/EEC of 30th October, 19891, and

Article 5 of Council Directive No. 90/658/EEC of 4 December 19902.

(2) The reference in Regulation 4 (2) of the Principal Regulations to paragraph (1) shall be construed as including a reference to paragraph (1) of this Regulation.

4. (1) The reference in Regulation 3 of the Principal Regulations to Directive No. 78/1026/EEC shall be construed as a reference to that Directive as amended and extended by Articles 16, 17 and 18 of Council Directive No. 89/594/EEC of 30th October, 1989, and Article 5 of Council Directive No. 90/658/EEC of 4 December, 1990.

(2) The reference in Regulation 3 of the Principal Regulations to Directive No. 78/1027/EEC shall be construed as a reference to that Directive as amended and extended by Articles 19 and 20 of Council Directive 89/594/EEC of 30th October, 1989.

EXPLANATORY NOTE.

These Regulations implement Council Directives 89/594/EEC and 90/658/EEC by amending existing legislation in relation to rights of establishment of veterinary surgeons in the European Community, the effect of which is:

( a ) to recognise:

(i) qualifications for which training commenced before December, 1980.

(ii) the special position of veterinarians whose training commenced in Italy before 31 December, 1984.

(iii) qualifications certified by Member States to be equal to the recognised qualifications, and

(iv) the qualifications issued in the former German Democratic Republic, and

( b ) to update the descriptions of the qualifications for Greece and Spain.
