EUROPEAN COMMUNITIES (CUSTOMS) REGULATIONS, 1992.

I, BERTIE AHERN, Minister for Finance, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving full effect to Council Regulation (EEC) No. 2503/88 of 25 July, 19881, Council Regulation (EEC) No. 2504/88 of 25 July, 19882, Commission Regulation (EEC) No. 2561/90 of 30 July, 19903, Commission Regulation (EEC) No. 2562/90 of 30 July, 19904, and Commission Regulation (EEC) No. 2485/91 of 29 July, 19915 hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Customs) Regulations, 1992.

2. Section 5 of the Customs Free Airport Act, 1947 (No. 5 of 1947), is herby amended by the deletion in paragraph (b) of subsection (1) of subparagraph (i).

3. Section 11 of the Finance (Miscellaneous Provisions) Act, 1958 (No. 28 of 1958) (as amended by Regulation 13 of the European Communities (Customs) Regulations, 1972 ( S.I. No. 334 of 1972 )) is hereby repealed.

4. The European Communities (Customs) Regulations, 1972 ( S.I. No 334 of 1972 ), are hereby amended by the deletion in Regulation 14 of paragraphs (3), (4) and (5).

5. The Free Ports Act, 1986 (No. 6 of 1986), is hereby amended—

( a ) in section 1, by the deletion of the definition of "usual forms of handling", and

( b ) by the substitution of the following section for section 10:

"10. (1) A person shall not contravene Council Regulation (EEC) No. 2504/88 of 25 July, 1988 or Commission Regulation (EEC) No. 2562/90 of 30 July, 1990, as amended by Commission Regulation (EEC) No. 2485/91 of 29 July, 1991.

(2) A person who contravenes subsection (1) of this section shall be guilty of an offence against the Customs Acts and shall be liable on summary conviction to a customs penalty not exceeding £1,000.

(3) Any goods in respect of which a contravention of this section has taken place shall be liable to forfeiture under the Customs Acts whether such goods are in the possession of the offender or some other person.".
