DISTRICT COURT (SERVICE OF SUMMONSES) RULES, 1992.

The District Court Rules Committee, in exercise of the powers conferred on them by section 91 of the Courts of Justice Act, 1924 , section 72 of the Courts of Justice Act, 1936 , section 17 of the Interpretation Act, 1937 (as applied by section 48 of the Courts (Supplemental Provisions) Act, 1961 ), and section 34 of the Courts (Supplemental Provisions) Act, 1961 , do hereby with the concurrence of the Minister for Justice, make the following Rules of Court:—

1. These Rules may be cited as the District Court (Service of Summonses) Rules, 1992.

2. These Rules shall come into operation on the 26th day of May, 1992 and shall be read together with all other District Court Rules for the time being in force.

3. In these Rules—

"the Act" means the Courts Act, 1991 (No. 20 of 1991).

4. Where, in a case of summary jurisdiction, the Court adjourns pursuant to section 22 (4) of the Act the hearing of a complaint or an accusation to which a particular summons relates and requires the person to whom the summons was directed to be notified of the adjourned hearing, the Clerk shall, unless the Court otherwise directs, issue and serve upon the person a notice in the Form 1 in the schedule hereto. Service shall be effected at least fourteen days before the date of the adjourned hearing and in such manner as the Court may direct. The original notice, with the details of service endorsed thereon, shall be retained by the Clerk and produced to the Court at said hearing.

5. (1) An application pursuant to section 22 (6) (a) of the Act to have proceedings set aside may be made at any sitting of the Court for the transaction of summary business for the court area wherein the hearing to which the relevant summons relates has taken place. Where such application is not made within 21 days after the said summons or hearing comes to the notice of the applicant, a further period within which to make the application may be sought ex parte at any sitting of the Court for the said court area.

(2) Notice of such application to have proceedings set aside shall be in the Form 2 in the schedule hereto. When completed, the notice shall forthwith be lodged with the Clerk for the said court area.

(3) Upon receipt of the notice the Clerk shall enter and list the matter for hearing and shall give, or send by ordinary post, to the applicant and the opposing party named in the proceedings which are sought to be set aside a notice in the Form 3 in the schedule hereto.

EXPLANATORY NOTE.

The Rules, which come into operation on 26th May, 1992, regulate the practice and procedure of the District Court in relation to District Court hearings adjourned, in certain circumstances, because the person to whom a summons is directed fails to appear — section 22 (4) of the Courts Act, 1991 — and prescribe the form of notice to be issued by the District Court to that person in such event. The Rules also regulate the practice and procedure of the District Court in regard to applications - under section 22 (6) (a) of the Act — for proceedings to be set aside on the ground that the applicant did not receive notice of the summons or of the hearing and prescribe (a) the form of the notice to be lodged with the District Court by the applicant and (b) the form of the notice of listing of such application for hearing to be issued by the District Court Clerk.
