EMPLOYMENT EQUALITY ACT, 1977 (EMPLOYMENT OF FEMALES ON UNDERGROUND WORK IN MINES) ORDER, 1989.

I, BERTIE AHERN, Minister for Labour, in exercise of the powers conferred on me by section 14 (2) of the Employment Equality Act, 1977 (No. 16 of 1977), hereby make the following order after due compliance with section 14 (2) (b) of that Act, and with respect to which, pursuant to section 14 (2) (c) of that Act, a draft has been laid before each House of the Oireachtas and a resolution approving of the draft has been passed by each such House:

1. This Order may be cited as the Employment Equality Act, 1977 (Employment of Females on Underground Work in Mines) Order, 1989.

2. The Mines and Quarries Act, 1965 (No. 7 of 1965), is hereby amended as follows:

( a ) by the deletion of subsection (1) of section 107;

( b ) by the deletion of subsection (1A) (inserted by the Employment Equality Act, 1977 (Employment of Females in Mines) Order, 1984 ( S.I. No. 176 of 1985 )) of the said section 107;

( c ) by the deletion, in subsection (5) (a) of section 110, of the word "male";

( d ) by the deletion, in subsections (1) and (3) of section 111, of the word "male".

EXPLANATORY NOTE.

A draft of this Order was laid before each House of the Oireachtas on 5th June, 1990. Resolutions approving the draft were passed by Dáil Éireann on 26th February, 1991 and by Seanad Éireann on 8th May, 1991.

The general effect of this Order is to allow women in all occupations, including manual occupations, to work below ground in a mine.
