GAS ACT 1976 (SECTIONS 4 AND 40A) REGULATIONS, 1990.

The Minister for Energy, in exercise of the powers conferred on him by sections 4 and 40A (as inserted by the European Communities (Environmental Impact Assessment) Regulations, 1989 ( S.I. No. 349 of 1989 )) of the Gas Act, 1976 (No. 30 of 1976), and the Energy (Transfer of Departmental Administration and Ministerial Functions) Order, 1980 ( S.I. No. 9 of 1980 ) (as adapted by the Industry and Energy (Alteration of Name of Department and Title of Minister) Order of 1983 ( S.I. No. 385 of 1983 )), hereby makes the following Regulations:

1. These Regulations may be cited as the Gas Act, 1976 (Sections 4 and 40A) Regulations, 1990.

2. In these Regulations "the Act of 1976" means the Gas Act, 1976 (No. 30 of 1976).

3. The prescribed period provided for in section 40A (2) (d) of the Act of 1976 shall be:

( a ) in the case of prescribed bodies, one month from the date of issue of a copy of the environmental impact statement to that body, and

( b ) in the case of any interested person, one month from date of publication in newspapers of the notice referred to in section 40A of the Act of 1976.

4. The prescribed bodies for the purpose of section 40A (4) of the Act of 1976 shall be:

( a ) all local authorities in whose area (all or part of) a proposed gas pipeline would be situated;

( b ) the Commissioners for Public Works in Ireland;

( c ) Bórd Fáilte Éireann;

( d ) National Heritage Council, the National Monuments Advisory Council and An Taisce.

EXPLANATORY NOTE

These Regulations provide for the prescribing of the period for considerastion of and submissions on environmental impact statements provided for under the European Communities (Environmental Impact Assessment) Regulation 1989, and lists the prescribed bodies to whom the environmental impact statements will be provided for comment.
