ROAD TRAFFIC (SPEED LIMITS) (COUNTY BOROUGH OF DUBLIN AND COUNTY OF DUBLIN) REGULATIONS, 1989.

The Minister for the Environment in exercise of the power conferred on him by sections 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County Borough of Dublin and County of Dublin) Regulations, 1989.

2 Commencement

2. These Regulations shall come into operation on the 28th day of August, 1989.

3 Interpretation

3. In these Regulations save where the context otherwise requires "the Act" means the Road Traffic Act, 1961 ;

"built-up area speed limit" and "special speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road;

"National Road" means a road declared to be a National Road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National Roads) Order, 1977 ( S.I. No. 164 of 1977 ) and any reference to the number of such road shall be a reference to the number of such road as shown in column 1 of the First Schedule or column 1 of the Second Schedule to the aforementioned Order;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a county borough, an urban district or a town and shall be considered as being within such boundary for the purposes of these Regulations; "road" means a public road.

4 Built-up area speed limit

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limits

5. (1) Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

(2) Fifty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Fourth Schedule to these Regulations.

6 Exceptions

6. There shall be excepted from the special speed limits prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

(a) ambulances,

(b) fire brigade vehicles, and

(c) vehicles used by members of the Garda Siochana in the performance of their duties as such members.

7 Revocations

7. The Road Traffic (Speed Limits) (County Borough of Dublin and County of Dublin) Regulations, 1977 ( S.I. No. 358 of 1977 ), the Road Traffic (Speed Limits) (County Borough of Dublin and County of Dublin) (Amendment) Regulations, 1978 ( S.I. No. 328 of 1978 ), the Road Traffic (Speed Limits) (County Borough of Dublin and County of Dublin) (Amendment) Regulations, 1981 ( S.I. No. 169 of 1981 ), the Road Traffic (Speed Limits) (County Borough of Dublin and County of Dublin) (Amendment) Regulations, 1982 ( S.I. No. 330 of 1982 ) and the Road Traffic (Speed Limits) (County Borough of Dublin and County of Dublin) (Amendment) Regulations, 1983 ( S.I. No. 217 of 1983 ) are hereby revoked.

FIRST SCHEDULE.

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the town of Balbriggan:

(a) The Hill Road for a distance of 260 metres north-east from the point where the town boundary intersects the northern side of the road.

(b) The Skerries Coast Road between a point where the town boundary intersects the eastern side of the road and a point 645 metres south-east of its junction with the County Bridge.

(c) The Dublin Road (National Road N1) for a distance of 237 metres from the town boundary.

2. The following roads in the County Borough of Dublin:

(a) Clontarf Road, James Larkin Road, Con Colbert Road, Davitt Road, Dublin Road (Kilbarrack).

(b) The Howth Road between a point 60 metres east of its junction with Brookwood Avenue and a point 46 metres south-west of its junction with Watermill Road.

(c) The Howth Road between a point 42 metres east of its junction with St. Assam's Road East and its junction with the James Larkin Road-Dublin Road (Kilbarrack).

(d) The Oscar Traynor Road between a point 320 metres east of its junction with Coolock Lane and a point 74 metres north-west of its junction with the Malahide Road.

(e) The Swords Road (National Road N1) between its junction with Griffith Avenue and a point 148 metres south-east of its junction with Larkhill Road.

(f) Upper Drumcondra Road (National Road N1)for a distance of 92 metres from its junction with Griffith Avenue.

(g) Griffith Avenue between a point 46 metres east of its junction with St. Mobhi Road and a point 23 metres east of its junction with Torlogh Parade.

(h) Finglas Road (National Road N2) between a point 100 metres south-east of its junction with Wellmount Road and a point 93 metres north-west of its junction with Tower View Cottages Road.

(i) Kylemore Road between its junction with the Naas Road (National Road N7) and a point 46 metres south of Kylemore Road railway bridge.

(j) Walkinstown Avenue between its junction with the Naas Road (National Road N7) and its junction with Long Mile Road.

(k) The Naas Road (National Road N7) between the county borough boundary and a point 137 metres south-west of its junction with Bluebell Avenue.

(l) Long Mile Road between the county borough boundary and a point 46 metres west of its junction with Walkinstown Parade.

(m) Merrion Road between the county borough boundary and a point 92 metres south-east of its junction with Sandymount Avenue.

(n) Ailesbury Road between a point 100 metres west of its junction with Merrion Road and a point 150 metres west of its junction with Ailesbury Drive.

(o) St. John's Road (Kilmainham) between a point 46 metres east of its junction with South Circular Road (National Road N7) and a point 46 metres west of its junction with Military Road.

(p) The Stillorgan Road (National Road N11) between the county borough boundary and a point 180 metres south of its junction with Anglesea Road.

(q) The Chapelizod Road (National Road N4) between a point 100 metres west of its junction with Phoenix Park access at Islandbridge Gate and a point 100 metres east of its junction with Phoenix Park access at Chapelizod Gate.

(r) Griffith Avenue Extension between a point 100 metres west of its junction with Ballymun Road and a point 100 metres east of its junction with Ballygall Road East.

(s) Collins Avenue Extension between a point 100 metres west of its junction with Crestfield Drive and a point 100 metres east of its junction with Shanowen Avenue.

(t) The Santry By-Pass and its continuation as the new Airport Road.

(u) Dunsinea Lane where the said road is a perimeter road.

(v) The Malahide Road between a point 50 metres north-west of its junction with the roundabout at Artane and the county borough boundary.

3. The following roads in the Borough of Dun Laoghaire:

(a) The Dublin-Bray Road (National Road N11), The Commons Road (Loughlinstown) for a distance of 19 metres from its junction with the Dublin-Bray Road (National Road N11).

(b) Rock Road between the borough boundary and its junction with Mount Merrion Avenue.

(c) Mount Merrion Avenue between its junction with the Stillorgan Road (National Road N11) and its junction with Rock Road.

(i) Cross Avenue for a distance of 10 metres from its junction with Mount Merrion Avenue.

(ii) Woodlands Park for a distance of 10 metres from its junction with Mount Merrion Avenue.

(iii) South Hill Avenue for a distance of 8 metres from its junction with Mount Merrion Avenue.

(iv) Grove Avenue for a distance of 8 metres from its junction with Mount Merrion Avenue.

(v) Hyde Park Avenue for a distance of 6 metres from its junction with Mount Merrion Avenue.

(vi) Glenvar Park for a distance of 8 metres from its junction with Mount Merrion Avenue.

(d) Frescati Road between its junction with Mount Merrion Avenue and its junctions with Temple Road and Barclay Court.

(e) Temple Road between a point 55 metres north west of its junction with Frescati Road and its junction with Newtown Avenue.

(f) Temple Hill between its junction with Newtown Avenue and its junction with Monkstown Road.

(g) Stradbrook Road between its junction with Monkstown Road and a point 12 metres north-west of its junction with Montpelier Place.

(h) Booterstown Avenue for a distance of 18 metres from its junction with Rock Road.

(i) Booterstown Avenue for a distance of 70 metres from its junction with the Stillorgan Road (National Road N.11).

(j) Carysfort Avenue between a point 40 metres north of its junction with Frescati Road and a point 23 metres south of the said junction.

(k) Georges Avenue, between a point 2 metres north of its junction with Frescati Road and a point 20 metres south of the said junction.

(l) Monkstown Road for a distance of 29 metres from its junction with Stradbrook Road.

(m) Newtown Avenue for a distance of 30 metres from its junction with Temple Road.

(n) Rock Hill for a distance of 23 metres from its junction with Frescati Road.

(o) Trimlestown Avenue for a distance of 32 metres from its junction with Rock Road.

(i) St. Helen's Road West for a distance of 18 metres from its junction with Rock Road.

(ii) St. Helen's Road East for a distance of 23 metres from its junction with Rock Road.

(p) Church Road, Ballybrack, between its junction with Rochestown Avenue and a point 62 metres south-east of its junction with the unnamed dual carriageway and including slip lane from Killiney Avenue to Church Road.

(i) The unnamed dual carriageway between its junction with the Old Wyattville Road and its junction with Church Road.

(q) Upper Glenageary Road between a point 28 metres south-east of its junction with Kill Avenue and a point 28 metres north-west of its junction with Sallynoggin Road.

(r) Upper Glenageary Road between a point 28 metres south-east of its junction with Sallynoggin Road and a point 28 metres west of its junction with Killiney Road.

(i) Gowrie Park for a distance of 11 metres from its junction with Upper Glenageary Road.

(ii) Glenageary Park for a distance of 5 metres from its junction with Upper Glenageary Road.

(iii) Adelaide Road for a distance of 12 metres from its junction with Upper Glenageary Road.

(iv) Bellevue Road for a distance of 10 metres from its junction with Upper Glenageary Road.

(s) The Stillorgan Road (National Road N11) where the said road is a perimeter road.

(t) The new Wyattville Road where the said road is a perimeter road.

(u) Loughlinstown Drive for a distance of 22 metres from its junction with the new Wyattville Road.

(v) The old Wyattville Road where the said road is a perimeter road.

SECOND SCHEDULE

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in and adjacent to the town of Balbriggan:

(a) All roads in the area (other than the roads described at reference 1 (e) and 1 (f) in the Third Schedule to these Regulations) enclosed by a line commencing at the point where the boundary of the town of Balbriggan intersects the eastern edge of the Dublin Road (National Road N1), thence in a southerly direction along the eastern edge of the Dublin Road (National Road N1) to where it meets the northern edge of Tanners Water Lane, thence in an easterly direction along the northern edge of Tanners Water Lane to where it meets the boundary of the town of Balbriggan on the western side of the Dublin-Belfast railway line, thence initially in a north westerly direction and thence in a mainly westerly direction along the boundary of the town of Balbriggan to the commencement point on the Dublin Road (National Road N1).

(b) The Naul Road for a distance of 76 metres south-west of the boundary of the town of Balbriggan.

(c) The Drogheda Road (National Road N1) for a distance of 15 metres north-west of the boundary of the town of Balbriggan.

2. The following roads in the areas of Baldoyle, Howth and Sutton and those roads in Kilbarrack which are outside the county borough boundary:

All roads in the area (other than the roads described at reference 2 in the Third Schedule to these Regulations) enclosed by a line commencing at a point on the eastern edge of the Coast Road, Baldoyle 155 metres north west of its junction with Willie Nolan Road, thence in a straight line to a point on the western edge of the Coast Road opposite the last mentioned point, thence in a straight line in a north westerly direction to a point on the county borough boundary where the Dublin Belfast railway line intersects the Mayne River, thence in a southerly direction along the county borough boundary to where it meets the Kilbarrack Road, thence in a south easterly direction along the county borough boundary to where it meets the coast, thence in a mainly easterly then southerly then northerly then westerly direction along the coast by Sutton and Howth to the commencement point at Baldoyle.

3. The following roads at Balrothery:

All roads in the area enclosed by a line commencing at a point on the eastern edge of the Old Dublin-Drogheda Road (National Road N1) through Balrothery at its junction with the eastern edge of the Dublin Raod (National Road N1) and drawn thence in straight lines successively to the following points:—

(a) a point on the eastern edge of the Dublin Road (National Road N1) 200 metres south-west of its junction with Matt Road,

(b) a point on the Balrothery-Courtlough Road 120 metres south of its junction with the Rosepark-Cross of the Cage Road,

(c) a point on the Rosepark-Cross of the Cage Road 25 metres from its junction with the Balrothery-Courtlough Road,

and thence in a northerly direction along the eastern edge of the Old Dublin-Drogheda Road (National Road N1) to the commencement point.

4. The following roads at Donabate-Portrane:

All roads (other than the roads described at Reference 5 of the Third Schedule to these Regulations) in the area enclosed by a line commencing at the north-westernmost point of the Burrow Road, Portrane, and drawn thence in straight lines successively to the following points:—

(a) the north-westernmost point of Beaverstown Road,

(b) a point on Turvey Avenue 197 metres north-west of its junction with the Portrane-Lissenhall Road,

(c) a point on the Portrane-Lissenhall Road 252 metres south-west of its junction with Kilcrea Road,

(d) a point on the Kilcrea Road 22 metres south-west of its junction with the Portrane-Lissenhall Road,

and thence in a straight line southwards to a point on the coast in the townland of Kilcrea, thence initially in an easterly and then in southerly, northerly, and westerly directions respectively along the high water mark to the commencement point on the Burrow Road.

5. The following roads adjacent to the County Borough of Dublin and the Borough of DunLaoghaire:

( a ) All roads (others than those roads in the area which are described at reference 6 in the Third Schedule to these Regulations) in the area which lies between the boundary of the County Borough of Dublin and a line drawn as follows:—

starting at a point on the county borough boundary where the Dublin-Belfast railway line intersects the Mayne River, thence in a straight line in a north-westerly direction to where it meets the eastern edge to the Hole in the Wall Road 45 metres south of its junction with the Balgriffin-Drimnagh Road, thence in a straight line to a point on the western edge of the Hole in the Wall Road opposite the last mentioned point, thence in a northerly direction along the western edge of the Hole in the Wall Road to where it meets the southern edge of the Balgriffin-Drimnagh Road, thence along the southern edge of the Balgriffin-Drimnagh Road to where it meets the eastern edge of the entrance road to Balgriffin Cottages, thence in a southerly direction along the eastern edge of the entrance road to Balgriffin Cottages to a point 16 metres from its junction with the Balgriffin-Drimnagh Road, thence in a straight line to a point on the western edge of the entrance road to Balgriffin Cottages opposite the last mentioned point, thence in a northerly direction along the western edge of the entrance road to Balgriffin Cottages to where it meets the southern edge of the Balgriffin-Drimnagh Road, thence in a westerly direction along the southern edge of the Balgriffin-Drimnagh Road to where it meets the eastern edge of the Malahide Road, thence in a southerly direction along the eastern edge of the Malahide Road to where it meets the county borough boundary, thence along the said boundary to where it meets the eastern edge of the Clonshaugh Road, thence in a northerly direction along the eastern edge of Clonshaugh Road to a point 30 metres from its junction with Turnapin Lane, thence in a straight line to a point on the western edge of Clonshaugh Road opposite the last mentioned point, thence in a southerly direction along the western edge of Clonshaugh Road to where it meets Turnapin Lane, thence along the northern edge of Turnapin Lane to the point where the said road turns southwards, thence in a straight line in a westerly direction to the centreline of Turnapin Bridge on the eastern edge of the Swords Road (National Road N1), thence in a southerly direction along the eastern edge of the Sword Road (National Road N1) to its junction with the northern edge of Turnapin Lane, thence along the northern edge of Turnapin Lane to a point 130 metres west of its junction with Constellation Road, thence in a straight line to a point on the southern edge of Turnapin Lane opposite the last mentioned point, thence along the southern edge of Turnapin Lane to its junction with the eastern edge of the Swords Road (National Road N1), thence in a southerly direction along the eastern edge of the Swords Road (National Road N1), to a point 1,006 metres north east of its junction with Santry Avenue, thence in a straight line to a point on the western edge of the Swords Road (National Road N1) opposite the last mentioned point, thence in a southwesterly direction to a point on the eastern edge of Ballymun Road 72 metres north of its junction with Santry Avenue, thence in a straight line to a point on the western edge of Ballymun Road opposite the last mentioned point, thence in a straight line to a point on the northern edge of the Dubber-Ballymun Crossroads Road 107 metres west of its junction with Ballymun Road, thence in a straight line to a point on the southern edge of the Dubber-Ballymun Crossroads Road opposite the last mentioned point, thence in a westerly direction along the southern edge of Dubber-Ballymun Crossroads Road to its junction with the eastern edge of Jamestown Road, thence in a southerly direction along the eastern edge of Jamestown Road to a point 600 metres north of the county borough boundary, thence in a straight line to a point on the western edge of Jamestown Road opposite the last mentioned point, thence in a southerly direction along the western edge of Jamestown Road to the county borough boundary.

(i) the Palmerstown By-Pass and its continuation as the Lucan By-Pass between a point 145 metres west of its junction with The Oval and a point 60 metres north west of its junction with Kew Park Crescent.

(ii) Adamstown Road between a point 90 metres north of its junction with the Lucan By-Pass and a point 70 metres south of the said junction.

(iii) Ballyowen Interchange inbound up ramp between a point 30 metres southwest of its junction with the Ballyowen Interchange and its junction with the Lucan By-Pass.

(iv) Ballyowen Interchange outbound down ramp between a point 980 metres west of the junction of Ballyowen Lane and the Palmerstown By-Pass and its junction with the Lucan By-Pass.

(v) Ballyowen Interchange outbound up ramp between a point 590 metres west of the junction of Ballyowen Lane and the Palmerstown By-Pass and its junction with the Lucan By-Pass.

(vi) Ballyowen Lane for a distance of 30 metres from its junction with the Palmerstown By-Pass.

(vii) Esker Lane for a distance of 54 metres south of its junction with the Lucan By-Pass.

(viii) The Fonthill-Newlands Road for a distance of 30 metres from its junction with the Palmerstown By-Pass.

(ix) Kennelsfort Road between a point 30 metres north of its junction with the Palmerstown By-Pass and a point 30 metres south of the said junction.

(x) Kew Park Crescent for a distance of 45 metres south of its junction with the Lucan By-Pass.

(xi) Leixlip Road inbound ramp at Crowes Corner between a point 40 metres west of its junction with the Celbridge Road and its junction with the Lucan By-Pass.

(xii) The link road, 260 metres east of the Fonthill-Newlands Road, between the Palmerstown By-Pass and the Lucan Road (National Road N4) for a distance of 30 metres from its junction with the Palmerstown By-Pass.

(xiii) The Lucan-Celbridge link road for a distance of 52 metres from its junction with the Lucan By-Pass.

(xiv) The Lucan Road (National Road N4) from a point 440 metres west of the junction of Ballyowen Lane and the Palmerstown By-pass and its junction with the Lucan By-Pass.

(xv) The road leading from St. Loman's Hospital for a distance of 30 metres from its junction with the Palmerstown By-Pass.

(xvi) Tandy's Lane for a distance of 45 metres north of its junction with the Lucan By-Pass.

(xvii) Vessey Park for a distance of 15 metres from its junction with Adamstown Road.

(xviii) The Cabinteely By-Pass between a point 120 metres south-east of the junction of the Dublin-Bray Road (National Road N11) with Westminster Road and a point 155 metres north-west of the junction of the Dublin-Bray Road (National Road N11) with Beech Park,

(xix) The Old Bray Road service road for a distance of 30 metres from its junction with the Cabinteely By-Pass,

(xx) The link road to the Dublin-Bray Road (National Road N11) near Mart Lane for a distance of 30 metres from its junction with the Cabinteely By-Pass.

(xxi) Clonkeen Road for a distance of 57 metres north of its junction with the Cabinteely By-Pass,

(xxii) Clonkeen Road Extension for a distance of 50 metres south of its junction with the Cabinteely By-Pass,

(xxiii) Johnstown Road between a point 55 metres north of its junction with the Cabinteely By-Pass and a point 55 metres south of the said junction.

(xxiv) the new Airport Road,

(xxv) The north bound entry road from Coolock Lane to the new Airport Road from a point on the road 80 metres north of the northern parapet wall of the northern bridge of the Coolock Lane interchange to its junction with the new Airport Road.

(xxvi) The south bound exit road from the new Airport Road to Coolock Lane from a point on the road 80 metres north of the northern parapet wall of the northern bridge of the Coolock Lane interchange to its junction with the new Airport Road.

(xxvii) The north bound exit road from the new Airport Road to Coolock Lane from a point 80 metres south of the southern parapet wall of the southern bridge of the Coolock Lane interchange to its junction with the new Airport Road.

(xxviii) The south bound entry road from Coolock Lane to the new Airport Road from a point 80 metres south of the southern parapet wall of the southern bridge of the Coolock Lane interchange to its junction with the new Airport Road.

(xxix) the roads described at reference 6 in the Third Schedule to these Regulations.

(xxx) The roads described at reference 3 in the Fourth Schedule to these Regulations

(National Road N3) 330 metres north west of its junction with Ashtown Road, thence in a south easterly direction along the northern edge of the Navan Road (National Road N3) to a point where the county borough boundary intersects the northern edge of the Navan Road (National Road N3), thence in a straight line to a point on the southern edge of the Navan Road (National Road N3) opposite the EXPLANATORY NOTE.

These Regulations revoke and replace the Road Traffic (Speed Limits) (County Borough of Dublin and County of Dublin) Regulations 1977 ( S.I. No. 358 of 1977 ) (as amended) and alter the speed limits applicable to certain roads in Dublin City and County and the Borough of Dun Laoghaire.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act 1961 .

The Regulations declare that the public roads mentioned in the Second Schedule which would otherwise be outside the scope of the built-up area speed limit of 30 mph shall be subject to that limit.

The Regulations prescribe a speed limit of 40 mph in respect of the public roads mentioned in the Third Schedule and a speed limit of 50 mph in respect of the public roads mentioned in the Fourth Schedule.

Ambulances, fire brigade vehicles and Garda Siochana vehicles while being used in the course of duty are exempted from all the speed limits prescribed by the Regulations.
