ROAD TRANSPORT ACT, 1978 (SECTION 5) ORDER, 1989.

I, JOHN P. WILSON, Minister for Tourism and Transport, in exercise of the powers conferred on me by Section 5 of the Road Transport Act, 1978 (No. 8 of 1978), and the Communications (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order, 1987 ( S.I. No. 92 of 1987 ), hereby order as follows:

1. This Order may be cited as the Road Transport Act, 1978 (Section 5) Order, 1989.

2. The classes of international transport which are set out in the Schedule to this Order (being the classes of international transport specified in Article 6 of the Agreement done at Dublin on the 8th day of June, 1988, on behalf of the Government and the Federal Executive Council of the Assembly of the Socialist Federal Republic of Yugoslavia on the international carriage of goods by road) are hereby exempted from the provisions of sections 9 and 34 of the Road Transport Act, 1933 (No. 8 of 1933) (as amended or extended) and section 7 of the Road Transport Act, 1935 (No. 23 of 1935) (as amended or extended).

3. The Road Transport Act, 1978 (Section 5) Order, 1988 ( S.I. No. 357 of 1988 ), is hereby revoked.

SCHEDULE

Classes of International Transport by Road referred to in Paragraph 2.

( a ) Transport of goods to and from airports in cases of aircraft emergencies, including cases in which flights have to be diverted;

( b ) Transport of damaged or broken-down vehicles;

( c ) Funeral transport;

( d ) Transport of exhibits intended for fairs or exhibitions;

( e ) Transport of properties, accessories and animals to or from theatrical, musical, film, sports or circus performances and; those intended for radio broadcasts or for film or television production;

( f ) Transport of medical supplies and equipment needed for emergencies, such as natural disasters;

( g ) Transport of mail;

( h ) Transport of bees and fish stock;

( i ) Unladen run of a vehicle sent to replace a broken-down vehicle and to continue the haul under cover of the permit issued for the broken-down vehicle.

EXPLANATORY NOTE.

The effect of this Order is that a merchandise licence, a vehicle plate, a licence under Section 7 of the Road Transport Act, 1935 or a restricted road freight licence under the Road Transport Acts are not required in respect of the classes of transport specified in paragraphs (a) to (i) of Article 6 of the Road Transport Agreement between the Government and the Federal Executive Council of the Assembly of the Socialist Federal Republic of Yugoslavia dated 8th June, 1988 and set out in the schedule to this Order.
