DROGHEDA APPOINTED STANDS (STREET SERVICE VEHICLES) BYE—LAWS, 1988.

I, EDWARD J. DOHERTY, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by section 84 (as amended by section 6 of the Road Traffic Act, 1968 (No. 25 of 1968)) of the Road Traffic Act, 1961 (No. 24 of 1961), with the consent of the Minister for the Environment, and after consultation with the Mayor, Aldermen and Burgesses of the borough of Drogheda, hereby make the following bye-laws in respect of the area comprising the borough of Drogheda.

1 Citation.

1. These bye-laws may be cited as the Drogheda Appointed Stands (Street Service Vehicles) Bye-Laws, 1988.

2 Interpretation.

2. In these bye-laws—

"street" means a public road;

reference to the head of an appointed stand shall, in respect of each such appointed stand referred to in the First Schedule to these bye-laws, be construed as referring to that end of the appointed stand concerned from which the limits of that appointed stand are reckoned in column (3) of that Schedule;

reference to the rear of an appointed stand shall, in respect of each such appointed stand referred to in the First Schedule to these by-laws, be construed as referring to that end of the appointed stand concerned to which the limits of that appointed stand are reckoned in column (3) of that Schedule;

reference to the order of the vehicles at an appointed stand shall be construed as referring to the order of the vehicles reckoned from the head of the appointed stand towards the rear of the appointed stand.

3 Appointment of appointed stands.

3. In each street named in column (2) of the First Schedule to these bye-laws, each part of the street described in column (3) of that Schedule opposite the mention in column (2) of the street shall be an appointed stand available, subject to these bye-laws, for use without limitation as to time or occasion of user.

4 Main and subsidiary appointed stands.

4. For the purpose of these bye-laws—

(a) the appointed stand mentioned in column (2) of the Second Schedule to these bye-laws shall be known as the main appointed stand and,

(b) the appointed stand mentioned in column (3) of the said Second Schedule shall be known as the subsidiary appointed stand

5 Position of vehicles at appointed stands.

5. (1)For the purpose of these bye-laws a street service vehicle shall be deemed not to be standing for hire at an appointed stand unless the whole of the vehicle is within the limits of the appointed stand described in column (3) of the First Schedule to these bye-laws.

(2) Every street service vehicle standing for hire at an appointed stand shall be placed—

(a) in the position specified in column (5) of the First Schedule to these bye-laws opposite the mention of the appointed stand in column (3) of that Schedule, and

(b) in case there is no street service vehicle already at the appointed stand, at the head of the appointed stand and, in any other case, next in order to the street service vehicle at the appointed stand and as near as practicable to the street service vehicle immediately in front,

and a street service vehicle shall be deemed for the purpose of these bye-laws not to be standing for hire at the appointed stand unless it complies with this paragraph.

(3 Where the First Schedule to these bye-laws requires a street service vehicle standing for hire at an appointed stand to be placed in single line by the kerb and parallel to the kerb, a vehicle shall not be placed more than 45 centimetres from the kerb.

6 Maximum numbers of street service vehicles at an appointed stands.

6. Whenever the number of street service vehicles standing for hire at an appointed stand is equal to the number mentioned in column (4) of the First Schedule to these bye-laws opposite the mention of the appointed stand in column (3) of that Schedule, the driver of a street service vehicle not already so standing for hire shall not place that street service vehicle at that appointed stand.

7 Vacancies at appointed stands.

7. (1) Whenever a vacancy occurs at an appointed stand by reason for the departure from the stand of a street service vehicle the street service vehicle nearest to the space so vacated shall be moved forward by it's driver into that space and each driver of any other street service vehicle then standing at that appointed stand shall in turn move forward his vehicle into the space which is nearest to him and in the direction of the head of the appointed stand.

(2) Whenever a vacancy occurs at the main appointed stand by reason of the departure from the stand of a street service vehicle, the driver of the street service vehicle at the head of the subsidiary appointed stand referred to in column (3) of the Second Schedule to these bye-laws shall place that street service vehicle on the main appointed stand in the space created by the vacancy.

8 General provisions relating to appointed stands.

8. The following provisions shall apply to street service vehicles standing for hire at an appointed stand:—

(a) a street service vehicle shall not be placed at an appointed stand that it rests wholly or partly on a footway, or that portion of the vehicle projects over the footway so as to interfere with the free movement of pedestrians on the footway;

(b) a person shall not wash, overhaul or execute repairs to such a street service vehicle, except such repairs as may be necessary to enable the vehicle to be removed from the appointed stand;

(c) neither the driver of such a street service vehicle nor any other person shall make any unnecessary noise by means of or in relation to the vehicle or the engine or any equipment, fittings or instruments fitted to or carried on the vehicle or any loudspeaker in or on or in any way connected with the vehicle;

(d) the driver of such a street service vehicle shall comply with all directions given to him by a member of the Garda Síochána in relation to the placing of the street service vehicle at the appointed stand or the bringing of the street service vehicle into or the removal of the street service vehicle from the appointed stand.

9 General restrictions on street service vehicles standing for hire.

9. A driver of a street service vehicle shall not stand the street service vehicle for hire otherwise than at an appointed stand and in accordance with these bye-laws.

10 Revocation.

10. The Drogheda Appointed Stands (Street Service Vehicles) Bye-Laws, 1973 ( S.I. No. 171 of 1974 ), are hereby revoked.

EXPLANATORY NOTE

These bye-laws—

1. provide stands for street service vehicles as indicated in the Schedule to these bye-laws;

2. outline the conditions subject to which street service vehicles may lawfully use the stands;

3. prohibit the driver of a street service vehicle from standing the vehicle for hire elsewhere than at an appointed stand in the borough of Drogheda;

4. revoke the Drogheda Appointed Stands (Street Service Vehicles) Bye-Laws 1973.
