DATA PROTECTION ACT, 1988 (COMMENCEMENT) ORDER, 1988.

I, GERARD COLLINS, Minister for Justice, in exercise of the powers conferred on me by section 35 of the Data Protection Act, 1988 (No. 25 of 1988), hereby make the following order:

1. This Order may be cited as the Data Protection Act, 1988 (Commencement) Order, 1988.

2. In this Order "the Act" means the Data Protection Act, 1988 (No. 25 of 1988).

3. The 9th day of January, 1989, is hereby fixed as the day on which the following provisions of the Act shall come into operation, namely:

(a) sections 1, 9, 16 (other than subsection (3)), 17, 18, 20,26 (other than paragraphs (a), (b) and (d) of subsection (1) and subsection (4)), 32 to 35, and

(b) the Second and Third Schedules.

4. The 19th day of April, 1989, is hereby fixed as the day on which the Act (other than sections 6 (2) (b) and 10 (7) (b) and the provisions specified in Regulation 3 of these Regulations) shall come into operation.

EXPLANATORY NOTE.

This order brings the registration provisions of the Data Protection Act 1988 into operation on 9 January 1989. It brings the remainder of the Act, with the exception of sections 6 (2) (b) and 10 (7) (b), into operation on 19 April 1989. The excepted provisions require individuals or firms who have to correct or erase inaccurate personal data pursuant to the Act to notify the correction or erasure to anyone to whom the data were disclosed within the preceding twelve months.
